Anti Monopoly Law Enters Into Operation Stage

On the occasion of the implementation of the antimonopoly law, the head of the Legislative Affairs Office of the State Council pointed out that the basic system of China's anti-monopoly is clear, the procedures are sound, the institutions are clear, and the operation of the anti-monopoly law has no problems.

The responsible person revealed yesterday that as for some guiding rules, the work needed to be perfected gradually in the implementation process is the rule of anti monopoly legislation.

In fact, there is no plan to set up supporting rules in advance.

If there is no specific law enforcement practice, the legal documents such as the anti monopoly guide can not be formulated, because such rules can only be the product of experience.

According to the law, there are only two items for the State Council to formulate antitrust matching rules. One is the establishment of the antimonopoly Committee of the State Council and the rules for the work of the Anti Monopoly Committee; the two is the formulation of the reporting standard for the concentration of operators.

At present, most of these two tasks have been clarified. The Anti Monopoly Committee has been established recently. The draft regulations on the standards for the concentration of business operators by the State Council have been approved by the Executive Council of the State Council in principle, and will be promulgated soon; the draft proposal on the work rules of the State Council's Anti Monopoly Committee is awaiting approval from the State Council.
