Ministry Of Labor And Social Security Stressed: Strict Arrears, Embezzled Wages Of Migrant Workers

According to the website of the Ministry of labor and social security of China, the Ministry of labor and social security issued a notice to carry out a special inspection of wages paid by migrant workers.

The notice stressed that we should seriously deal with arrears and embezzling wages for migrant workers.

In recent years, people's governments at all levels and their labor security, construction, public security and other relevant departments and trade unions at all levels have conscientiously implemented the spirit of the relevant documents of the State Council on solving the problems of migrant workers (No. 2006 [5]) and adopted effective measures to solve the problem of arrears of wages for migrant workers.

The notice also pointed out that owing to various complex reasons, arrears of wages happen frequently.

In order to effectively protect the legitimate rights and interests of migrant workers, ensure the smooth harvest of migrant workers during the new year and Spring Festival in 2008 and return happily to the new year in the new year, consolidate and improve the long-term mechanism to solve the wage problem of migrant workers and maintain social stability. The Ministry of labor and social security, the Ministry of construction, the Ministry of public security and the National Federation of trade unions decided to continue to organize special inspections of migrant workers' wage payment from October 19, 2007 to January 31, 2008.

The notice stressed that we should seriously deal with arrears and embezzling wages for migrant workers.

If the employer fails to submit written materials or conceals the amount of wages owed or deducted the amount of wages, the labor and social security department shall be ordered to make corrections in accordance with the relevant provisions of the labor security supervision Ordinance, and impose a fine on those who refuse to correct them.

In the process of handling in accordance with the law, the employers should pay public exposure in accordance with the relevant provisions of the labor security supervision Ordinance.

In accordance with the spirit of the State Council's opinions on solving the problems of migrant workers, we should further increase the penalties for arrears of wages of migrant workers. If malicious arrears and serious circumstances are committed, they can be ordered to suspend business for rectification, reduce or cancel their qualifications until the business license is revoked.

The employing units that pay wages for migrant workers and do not pay overtime wages according to the minimum wage regulations of the State shall be dealt with according to law in time.
