    Administrative Measures For Chinese Citizens To Travel To And From Taiwan

    general provisions

     

    Article 1. These measures are formulated for the purpose of safeguarding personnel exchanges on both sides of the Taiwan Straits, promoting exchanges among all parties and maintaining social order.


    The second Chinese citizens living in the mainland (hereinafter referred to as mainland residents) who apply to Taiwan area (hereinafter referred to as Taiwan) and Chinese citizens living in Taiwan area (hereinafter referred to as Taiwan residents) to mainland China shall apply these measures.

    Other laws and regulations are applicable to matters not stipulated in these measures and other relevant laws and regulations.


    The third mainland residents go to Taiwan, and travel from the open or designated entry and exit ports with the travel documents issued by the exit entry administration departments of the public security organs.


    The fourth Taiwan residents come to the mainland and pass through open or designated entry and exit ports on the basis of travel documents issued by the competent state organs.


    Fifth Chinese citizens should not be allowed to engage in the acts of endangering national security, honor and interests between Taiwan and the mainland.

     

    The second chapter mainland residents go to Taiwan.


    Sixth mainland residents who go to Taiwan to settle down, visit relatives, visit friends, travel, accept and deal with property, deal with weddings or funeral or participate in activities such as economy, science and technology, culture, education, sports and academic activities, shall apply to the municipal and county public security bureaus of the place where they are registered.


    The seventh mainland residents applying for the trip to Taiwan must perform the following procedures:


    (1) verification of identity and household registration;


    (two) fill in the application form for Taiwan.


    (three) in-service and in service personnel should submit their opinions on the applicant's visit to Taiwan; non incumbents and scholars should submit their opinions to the Taiwan police station where their residence is located.


    (four) the proof of the submission of the application.


    The eighth article, the seventh item and the fourth item, refers to:


    (1) a certificate to settle down in Taiwan must be submitted to settle down.


    (two) to visit relatives and visit friends, it is necessary to submit proof of the relationship between relatives and friends in Taiwan.


    (three) travel is required to submit proof of travel cost.


    (four) the acceptance and disposal of property shall submit a notarized proof of the lawful right of the property.


    (five) in handling marital affairs, a notarized proof of marital status shall be submitted.


    (six) to deal with the funeral of the relatives and friends, the relevant correspondence or notice shall be submitted.


    (seven) to participate in the activities of economic, scientific, cultural, educational, sports, and academic activities, it is necessary to submit a certificate to the corresponding institutions, groups, individuals, or consent to participate in the activities of the Taiwan.


    (eight) other certificates deemed to be required by the competent authority.


    If the ninth public security organs accept the application of mainland residents to Taiwan, within thirty days, the decision to give approval or disapproval within sixty days should be notified to the applicant if they are remote and inconvenient.

    Urgent applications should be processed at any time.


    The tenth mainland residents who have been approved to go to Taiwan are issued or endorsed by the public security organs.


    The eleventh mainland residents who have been approved to go to Taiwan should go within the validity period of the endorsement of their travel documents, and shall return on time.


    After the mainland residents travel to Taiwan, due to illness or other special circumstances, when the travel documents fail to return on schedule, they may apply for extension procedures to the public security organs issued by the original issuing authority or the relevant agencies issued by the exit Entry Administration Bureau of the Ministry of public security or the entrusted agencies; for special reasons, they may apply for entry formalities at the public security organs at the port of entry.


    Twelfth mainland residents who apply to Taiwan will not be permitted to approve one of the following situations:


    (1) a defendant or criminal suspect in a criminal case;


    (two) if the people's court has notified an unsettled lawsuit, it is advisable not to leave the territory.


    (three) the sentence has not yet been executed.


    (four) being reeducated through labour;


    (five) the competent departments of the State Council believe that after leaving the country, they will cause harm to national security or cause significant losses to national interests.


    (six) fraudulent practices such as fabricating situations or providing false certificates.


    The third chapter is Taiwan residents coming to mainland China.


    Thirteenth Taiwan residents who require mainland China to apply for travel documents to the following authorities:


    (1) from the Taiwan region directly to the mainland, they should apply to the relevant agencies dispatched by the exit Entry Administration Bureau of the Ministry of public security or the entrusted agencies; for special reasons, they may also apply to the public security organs at the designated ports.


    (two) to the mainland of Hongkong and Macao, apply to the institutions dispatched by the exit Entry Administration Bureau of the Ministry of public security or the relevant institutions entrusted in Hongkong and Macao.


    (three) in accordance with the law of the People's Republic of China on the administration of entry and exit by foreigners, the foreign representative offices, consular offices or other authorized foreign offices authorized by the Ministry of foreign affairs of the People's Republic of China shall be applied for through foreign countries.


    Fourteenth Taiwan residents applying for the mainland must perform the following procedures:


    (1) the examination shows that valid identity cards and exit and entry certificates reside in Taiwan;


    (two) fill in the application form;


    (three) through other regions and countries, it is necessary to submit the re entry permit certificate for the region or country, except for the regions and countries that do not need to endorse the pit.

    (four) those who settle down, visit relatives, visit friends, travel, accept and deal with property and deal with weddings and funerals must submit corresponding proofs for application.


    (five) for economic, technological, cultural, educational, sports, academic and other activities, it is necessary to submit an invitation from the mainland's corresponding institutions, groups or individuals or to agree to participate in the activity.


    The fifteenth issue is the issuance or endorsement of travel documents by the competent authorities of the Taiwan for the mainland residents authorized to come to the mainland.


    Sixteenth Taiwan residents who need to come to the mainland for many times because of their investment in the mainland, trade or other economic activities or coming to China after other affairs, may apply to the local city or county public security organs for many effective endorsements.


    Seventeenth Taiwan residents who need to go to the mainland after they come to the mainland should be handled according to the law of the People's Republic of China on the administration of entry and exit and the detailed rules for their implementation.


    The eighteenth Taiwan residents who come to the mainland in the short term should handle temporary residence registration according to the provisions of Hukou management.

    Lodging in hotels, restaurants, hostels, hotels, schools and other enterprises, institutions or organizations, groups and other institutions shall fill in the registration form for temporary residence. Those who live in relatives and friends should go to the local public security police station or the household registration office for temporary residence registration within twenty-four hours (seventy-two hours in the countryside).


    If nineteenth Taiwan residents are required to stay in the mainland for more than three months after they come to the mainland, they shall apply for temporary residence permits to the local city or county public security bureaus.


    Twentieth Taiwan residents who request to settle in the mainland shall apply to the relevant agencies dispatched by the exit Entry Administration of the Ministry of public security or the entrusted agencies before entering the country, or apply for applications to the city or county public security bureaus to be settled by the mainland relatives.

    The public security organ shall issue a certificate of residence for those who have settled down.


    After the twenty-first Taiwan residents come to the mainland, they should leave the country within the validity period of the endorsement of their documents except for settlement.

    If there is any need to extend the stay period, it is necessary to submit corresponding proofs and apply for extension procedures to the municipal and county public security bureaus.


    Twenty-second Taiwan residents who apply to the mainland will not be permitted to approve one of the following situations:


    (1) being considered guilty;


    (two) it may be considered possible to do harm to national security and interests after coming to the mainland.


    (three) fraudulent practices such as fabricating situations or providing false certificates;


    (four) patients with mental illness or serious infectious diseases.


    Exceptions can be granted for treatment or other special reasons.


    Fourth chapter exit and Entry Inspection


    Twenty-third mainland residents visiting Taiwan and Taiwan residents coming to the mainland must show their certificates to the open or designated frontier inspection points, and fill in the exit and entry registration cards for inspection.


    The twenty-fourth frontier inspection stations shall have the right to prevent entry and entry:


    (1) not holding travel documents;


    (two) holding invalid travel documents such as forgery or alteration;


    (three) refusing to submit travel documents;


    (four) the twelfth and twenty-second stipulates that no exit or entry is permitted.


    The fifth chapter is document management.


    Twenty-fifth travel documents from mainland residents to Taiwan refer to mainland residents' travel permits and other valid travel documents to Taiwan.


    The twenty-sixth travel documents of Taiwan residents to and from the mainland refer to the mainland residents' pass and other valid travel documents of Taiwan residents.


    Twenty-seventh mainland residents to Taiwan pass, Taiwan residents to the mainland pass, the holder of the preservation, valid for five years.


    Twenty-eighth mainland residents to Taiwan pass, Taiwan residents to mainland pass, the implementation of successive endorsement.

    Endorsement is valid once and for several times.


    Twenty-ninth mainland residents who lost their travel documents should report the loss to the public security organs where the original license was issued. If the investigation is true, they can be reissued to the corresponding travel documents.


    If thirtieth Taiwan residents lose their travel documents on the mainland, they should report the loss to the local public security organs. If the investigation is true, they can apply for the corresponding travel documents, or issue a valid exit document.


    The holders of thirty-first mainland residents who travel to Taiwan and Taiwan to travel documents on the mainland have one of the twelfth or twenty-second provisions of the present measures. Their certificates should be revoked or declared invalid.


    The thirty-second organ that approving and issuing travel documents has the right to revoke or declare the travel documents issued.

    The Ministry of public security may, when necessary, change its endorsement, revoke its travel documents or declare it invalid.


    The sixth chapter is punishment.


    Article thirty-third if a valid travel document, such as forgery or alteration, is used for the purpose of leaving or entering the country, it may be fined not less than one hundred yuan or less than five hundred yuan except in accordance with the provisions of article twenty-third of the detailed rules for the implementation of the law of the People's Republic of China on the administration of exit and entry of citizens.


    Thirty-fourth, forgery, alteration, pfer or reselling of travel documents, except for Punishments under article twenty-fourth of the detailed rules for the implementation of the law of the People's Republic of China on the administration of exit and entry of citizens, they may be fined at least five hundred yuan or less than three thousand yuan.


    Thirty-fifth cases of fabricating, providing false proof, or obtaining travel documents by means of bribery, etc.
