Chinese Shoe Or EU Anti-Dumping Review Again

"Because the anti-dumping measures on leather shoes will expire at the end of March next year, according to EU law, the EU Industrial retrial appeal must be submitted by the end of December."

In the interview with our reporter, Pu Ling, who has been acting as an agent for anti-dumping cases involving leather shoes in China, said in an interview with our reporter that the European footwear Federation is likely to submit anti-dumping appeals again before the end of December due to the active attitude of Italy and Spain.

"This will mean that the anti-dumping duty will continue for some time."

In 2006, 5 Chinese shoe companies, such as AOKANG, believed that the European Commission had violated the law in the course of the investigation and filed a judicial review in the first instance court in December 2006.

The lawsuit lasted nearly 4 years. In March 2010, the European Court of first instance rejected the claim of 5 Chinese shoe companies.

In June 2010, Chinese shoe companies such as AOKANG filed suit against the EU high court again.

"At present, the European Union High Court is hearing the defense procedures of the two sides involved, and is expected to end early next year.

If necessary, the high court will also hold an oral reply. "

Pu Ling said that the EU is a relatively respected legal association, the case will not be too much political and economic factors interference, the outcome of the high court judgment should be more optimistic.

Pu Ling Chen disclosed that the first round of the WTO expert group's meeting had just ended and the parties informed the situation of the case.

The second round of the meeting will be held around January 20th next year, and the parties will plead at the meeting.

The outcome of the ruling will be seen in March next year.

It is reported that the Ministry of Commerce of China drew the WTO to set up a task force in early 2010 to hear the case.

In May 18th, the WTO dispute settlement body (DSB) formally set up an expert group to examine the relevant provisions of the EU anti-dumping basic law and the EU's anti-dumping measures against Chinese leather shoes.
