Why did Guangzhou adjust the minimum wage standard for enterprise workers again? Why was it set at 1300 yuan? Should the welfare and allowances of enterprises be included in the minimum wage standard? Would such a labor intensive enterprise be driven out of Guangzhou? The head of Guangzhou human resources and Social Security Bureau explained this in detail.
Urban and Panyu Huadu adjust different standards
Considering that there are certain differences in the level of economic development between Panyu, Huadu, Nansha, Conghua and Zengcheng and other parts of the city, Guangzhou has included these districts and county-level cities in two categories of provinces.
According to the introduction, Guangzhou (Panyu District, Huadu District, Nansha District, Conghua, Zengcheng), the implementation of the minimum wage standard for enterprises in the province, is adjusted from 1100 yuan / month to 1300 yuan / month, the minimum wage standard of hour is adjusted from 6.32 yuan / hour to 7.47 yuan / hour; the part-time worker hour minimum wage standard is adjusted from 10.6 yuan / hour to 12.5 yuan / hour.
The minimum wage standards in Panyu District, Huadu District, Nansha District, Conghua and Zengcheng will continue to be implemented according to the two regional standards of the province. The minimum wage standard for their employees will be adjusted from 960 yuan / month to 1100 yuan / month and the minimum wage standard from 5.52 yuan / hour to 6.32 yuan / hour; the part-time minimum wage for workers will be adjusted from 9.2 yuan / hour to 10.5 yuan / hour.
The minimum wage in Guangzhou is at a high level in the whole country.
Question 1: Why did Guangzhou raise the minimum wage standard again in less than a year in 2010, when it raised the minimum wage standard in a big way?
Answer: this time, we should consider the following factors: first, implement the spirit of the CPC Central Committee and the State Council to raise the income level of low-income workers. The municipal Party committee and the municipal government have always attached importance to the issue of living security for low-income workers, and timely and moderately raising the minimum wage standard is a concrete measure for the municipal Party committee and the municipal government to implement the decision-making spirit of the Party Central Committee and pay close attention to people's livelihood. Second, stimulate consumption and expand domestic demand. China's economy is driven by investment, foreign trade and consumption, the "three carriages". Third, economic growth requires objectively raising the minimum wage standard. Fourth, prices, especially food prices continue to rise, it is necessary to raise the minimum wage standard to protect the basic livelihood of low-income workers.
Question two: what is the minimum wage standard in Guangzhou at present?
A: if we only look at the standards, Guangzhou is the highest in the country. This year, Beijing and Jiangsu have adjusted the minimum wage standard. Beijing has been adjusted from 960 yuan / month to 1160 yuan / month from January 1st this year. Jiangsu has been adjusted from 960 yuan / month to 1140 yuan / month from February 1st this year. Guangzhou's standard is higher than that of Jiangsu. However, the minimum wage standard in Beijing does not include the social insurance premiums and housing provident funds paid by the workers. If the social insurance premium and housing accumulation fund paid by the workers are deducted, the minimum wage in Guangzhou is actually between 1050~1100 yuan, which is also at a high level in all major cities of the country.
Question three: 1300 yuan refers to the actual wages paid by workers?
Answer: the minimum wage does not include the following: (1) overtime pay; (two) allowances for special working conditions and conditions such as middle class, night shift, high temperature, low temperature, underground, toxic and harmful conditions; (three) labourers' insurance and welfare benefits stipulated by national laws, regulations and policies; (four) non monetary income paid to workers by enterprises or employers through subsidizing meals and housing. However, the social insurance premiums paid by the laborers themselves and the personal expenditure items of the housing surplus can be withheld and paid in their wages.
Question four: now, some enterprises regard the minimum wage standard as the wage standard of all or part of the enterprise as the base of calculating overtime wages. Is that right?
Answer: the minimum wage standard is a safeguard standard stipulated by the state, not the allocation standard of enterprises. Enterprises should not equate it with the distribution system of enterprises, take the minimum wage standard as the wage standard paid by enterprises, simply use the minimum wage standard as the wage base for calculating overtime pay, and even do not divide the minimum wage into several parts, and calculate overtime pay by one part.
Therefore, in regard to the employing units with normal growth in production and operation and continuous economic growth, they shall not, in principle, pay wages for labourers in the statutory working hours on the basis of the minimum wage, and pay the wages of all workers or part of their workers on the basis of the minimum wage standard due to the reasons of production and operation.
Raise the minimum wage, most enterprises have no pressure.
Question five: some people say that a substantial increase in the minimum wage standard is to drive labor-intensive enterprises out of Guangzhou.
Answer: the transfer and closure of enterprises are determined by market rules, and the government will not interfere with the survival of the fittest. When adjusting the minimum wage, the government also fully considered the cost bearing capacity of most enterprises, and ensured that it would not affect the production and operation of the vast majority of enterprises.
However, it is not ruled out that a small number of enterprises can not undertake the relocation because of raising the minimum wage standard and can not undertake the relocation of labor costs. This may be because these enterprises have low technology content and low added value. They may also be the production and operation strategies of enterprises. They need to upgrade technology or transfer production links to low cost areas in order to earn higher profits, which is the normal production and operation behavior of enterprises under the market rule.
Question six: will the increase in standards affect the production and operation of enterprises, especially small and medium-sized enterprises?
Answer: the standard of 1300 yuan / month has comprehensively considered the factors that affect the steady development of enterprises in order to avoid one adjustment in place, and has also solicited opinions from some enterprises and trade associations. Judging from the salary situation of Guangzhou's labor market, the minimum salary for most enterprises is above this level, and now a general worker is recruited in the market, and the salary is basically above 1500 yuan. Moreover, due to the shortage of structural labor, the recruitment of wages in Guangzhou's human resources market will also increase after the Spring Festival. Therefore, the minimum wage of 1300 yuan will not affect the production and operation of the vast majority of enterprises.
Signed a labor contract, the minimum wage still rises.
Question seven: how can a laborer defend his legitimate rights and interests if the employer pays wages less than the minimum wage?
Answer: if the wages paid by the employer to the workers are below the minimum wage standard, the laborers can report to the local labor and social security supervision department. The hotline for reporting illegal labor activities in Guangzhou area is 12333, and all districts and counties have also set up the complaint telephone, and the specific number can be querying online in Guangzhou labor security information.
Question eight: there are workers who say that the government raises the minimum wage standard, but workers increase their working hours or increase their work intensity. Workers still can not get the benefits. What is the government's handling of this violation of regulations?
Answer: it should be said that the vast majority of enterprises are law-abiding, and earnestly implement the minimum wage protection regulations. However, when checking the enterprises in peacetime, it is found that there are such behaviors in individual enterprises.
The violation of the minimum wage regulations will be dealt with seriously and will not be tolerated. When the labor and social security supervision department inspected, it found that the above actions, or the laborers' complaints, and the labor and social security supervision department verified the existence of these acts by the enterprises, and promptly ordered the enterprises to make rectification within a specified time, reissued the wages of the workers according to the regulations. If the overdue payment was not paid, the enterprises should be ordered to pay compensation to the workers in accordance with the 1~5 times they owed. If the circumstances were serious, they could also be fined 5000 yuan or less than 50 thousand yuan.
Question nine: if the salary stipulated in the labor contract signed by the enterprise and the staff before March 1st is lower than the new standard, how will it be implemented?
Answer: whether the wage stipulated in the labor contract signed by the enterprise and the employee is signed before March 1st, whether it is a fixed period or no fixed period labor contract, it will be adjusted automatically after the salary is released after March 1st, which is lower than the newly announced minimum wage standard of the whole city, and strictly enforced according to the new standard.
The Guangzhou Municipal Bureau of human resources and social security also suggests that enterprises can clearly apply the new minimum wage standard by changing labor contracts or collective contracts and collective wage agreements. The minimum wage standards promulgated by Guangzhou have legal effect and coercive force.
