Two Ministries And Commissions Promulgated The "New Cocoon Purchase Qualification Accreditation"
The "qualification confirmation method for fresh cocoon purchase" has been examined and approved by the tenth ministerial meeting of the Ministry of Commerce in December 20, 2006 and has been approved by the General Administration of industry and commerce. It is hereby promulgated and will take effect as of August 1, 2007.
Article 1 in order to regulate the qualification confirmation of fresh cocoon purchase, these measures are formulated in accordance with relevant laws and regulations of the state. In the second way, the acquisition of fresh cocoons refers to the behavior of buying silkworm cocoons that are not dried by pupae. Third article The State applies the qualification recognition system to the acquisition of fresh cocoons. Those who engage in the acquisition of fresh cocoons in People's Republic of China must qualify through the acquisition of fresh cocoons, acquire the qualification of fresh cocoon purchase, and register with the administrative departments for Industry and commerce. The purchase of fresh cocoons, as mentioned in these measures, includes units engaged in fresh cocoon purchase and their branches. The fourth Ministry of commerce is responsible for the management of the qualification of fresh cocoon purchase in China. The provincial commerce department (cocoon silk Office) has formulated detailed rules for implementation in light of the actual situation of the region. The provincial commerce department (cocoon wire Office) is specifically responsible for the qualification confirmation of the fresh cocoon purchasing operators in the region, and issued the "fresh cocoon purchase qualification certificate", which is released to the public and submitted to the Ministry of Commerce for the record. The qualification confirmation of the fresh cocoon purchase of the provincial commerce department (cocoon silk Office) shall not be delegated. The industry and commerce administration department is responsible for the supervision and management of the market order of fresh cocoon purchase according to its responsibilities. The identification of the fifth fresh cocoons should adhere to the principle of moderate scale, relatively concentrated and conducive to the integration of trade and industry, and improve the organization of the production and management of sericultural production. Sixth article Encourage Silk Reeling Enterprises and silk enterprises (including trade and industry integration enterprises that build bases, build factories and build companies) to establish stable economic relations with sericulture farmers and sericulture cooperation organizations, provide venture capital, provide technical services, and cooperate with silkworm farmers in order purchase and repurchase.
Encourage trade, industry and agriculture integration filature and silk production enterprises to engage in Fresh Cocoon acquisition activities in sericulture base construction and new rural construction. Seventh Fresh Cocoon acquisition operators must be eligible to purchase fresh cocoons for the acquisition of fresh cocoons.
Operators who acquire the qualification of fresh cocoon should have the following conditions: (1) in line with the local sericultural production above the county level and the layout of cocoon station layout, there is a stable source of fresh cocoon cocoons. (two) financial strength that is compatible with acquisition capability. (three) having a perfect and scientific quality assurance system and relevant management system, including the management system of employees, the work norm of each kind of work procedure, and the post responsibility system. (four) the acquisition, inspection and storage sites that are matched with the amount of cocoon purchased and the amount of cocoon handled are purchased. The purchase of stores, storage areas and cocoon drying grounds should be no less than 0.2 square meters, 0.2 square meters and 0.4 square meters of fresh cocoons per 50 kg respectively. (five) the purchase, inspection and cocoon drying of fresh cocoons are required to be fully equipped, in line with national or industrial standards, in good working order, and in line with purchasing capacity. All equipment should be in effective use. (six) the facilities and environment for fresh cocoon purchase and dry cocoon storage should have the capabilities of moisture-proof, pest control, rodent prevention, fire prevention and anti-theft, and meet the requirements of the state or industry concerning labor safety, fire protection and environmental protection. (seven) other conditions stipulated by laws and administrative regulations. Eighth, encourage the use of fresh cocoon to buy operators to use energy saving, safe and environmentally friendly cocoon drying equipment. Ninth operators who intend to engage in the acquisition of fresh cocoons shall submit the application for qualification confirmation of fresh cocoon purchase to the county commercial department (cocoon wire Office) at the locality, and provide relevant materials as required. Tenth article The competent commercial department at the county level is responsible for accepting the application materials for the purchase of fresh cocoons at the locality, conducting on-the-spot investigation and examination of the authenticity of the application materials and the rationality of the acquisition layout, and submitting the application materials and audit opinions to the provincial commerce department (cocoon wire Office) step by step. The provincial commerce department (cocoon wire Office) approved the operators of the province (autonomous regions and municipalities directly under the central government) to acquire the qualification of fresh cocoon purchase, issued the "fresh cocoon purchase qualification certificate", and submitted the approval document to the Ministry of Commerce for the record. Eleventh article The qualification certificate for fresh cocoon purchase is made by the provincial commerce department (cocoon silk Office). The main contents of "fresh cocoon purchase qualification certificate" should include the certificate number, the name, residence, legal representative, acquisition area, issuing time and validity period of the fresh cocoon purchaser. Twelfth operators engaged in the acquisition of fresh cocoons hold the "certificate of fresh cocoon purchase" to the industrial and commercial administration department for business registration or change registration. Thirteenth article The validity period of fresh cocoon purchase qualification is two years, which is reviewed every two years (before the annual inspection of the business sector). The purchasing operator shall, on the 60 day before the expiration of the "fresh cocoon purchase qualification certificate", submit an application for examination to the county commercial department (cocoon wire Office) at the locality, and after the approval of the County Commerce Department (cocoon wire Office), it shall be reported to the provincial commerce Department (cocoon wire Office) for approval to replace the new certificate. The Department of commerce at the provincial level will report to the Ministry of Commerce before the end of March next year. The fourteenth provincial competent commercial department (cocoon wire Office), after accepting the application materials for the acquisition of fresh cocoons, should complete the qualification approval of Fresh Cocoon acquisition within 45 days. The fifteenth provincial commerce department (cocoon wire Office) should regularly announce to the public the list of operators who have acquired the qualification of fresh cocoon and accept social supervision. Those who do not meet the qualification requirements of the purchase shall cancel their qualification for the acquisition of fresh cocoons, cancel their "qualification certificate for fresh cocoons", announce to the public, and notify the original registered industrial and commercial administrative department within 5 days. The operator who has cancelled the qualification of fresh cocoon purchase shall, within 20 days from the date of disqualification, go to the administrative department for Industry and Commerce for registration of change or cancellation. Sixteenth operators who have acquired the qualification of fresh cocoon should report to the local commerce department (cocoon wire Office) in time for the purchase of cocoons, and accept the supervision and management of the competent commercial department (cocoon silk Office). If the seventeenth fresh cocoon purchasing operators have the following actions, the determination organ shall cancel the qualification of the fresh cocoon purchase, announce it to the public, and report it to the Ministry of Commerce for record, and be punished by the administrative department for Industry and Commerce in accordance with relevant laws and regulations. (1) intentionally concealing the true situation or providing false materials in the application for qualification recognition; (two) beyond the approval area of the "fresh cocoon purchase qualification", it is engaged in the acquisition activities. (three) lease or pfer the qualification certificate of Fresh Cocoon acquisition, or expire, forge or alter the qualification certificate of Fresh Cocoon acquisition. (four) other violations of laws and administrative regulations, disrupting the order of fresh cocoons. The eighteenth departments that implement the qualification confirmation of fresh cocoons should ensure that the qualification of Fresh Cocoon acquisition is fair, just and open. The staff in charge of Commerce and the administrative departments of industry and Commerce shall abuse their powers, engage in malpractices for selfish ends, neglect their duties and take bribes and bribes, and shall be subject to administrative sanctions against the responsible and directly responsible personnel. If a crime is constituted, they shall be investigated for criminal responsibility according to law. The management of nineteenth tussah fresh cocoons purchase qualification is referred to the execution of silkworm fresh cocoons, and the implementation details are formulated by the provincial commerce department (cocoon wire) according to the local practice. The twentieth way is to be explained by the Ministry of Commerce and the State Administration for Industry and commerce. The twenty-first measures have been implemented since August 1, 2007.
