Main Contents And Characteristics Of Patent Right

(1) inventions and utility models: manufacture, use, promise to sell, sell and import;

Apart from the provisions of this law, no entity or individual may, without the permission of the patenor, implement its patent unless it is otherwise provided for by the patent law, that is, it is not allowed to manufacture, use, promise to sell, sell or import its patented product for the purpose of production and operation, or use its patented method and use, promise to sell, sell or import products directly obtained according to the patent method.

     （2）外觀設計：制造、銷售、進口。

After the grant of the patent right for design, no entity or individual may, without the permission of the patenor, implement its patent, that is, it shall not manufacture, sell or import its design patent products for the purpose of production and operation.

The patent right is a special right granted by the patent administration department under the State Council to the patented person in accordance with the law and in accordance with the legal procedure.

　　（1）具有獨占性。所謂獨占性亦稱壟斷性或專有性。專利權是由政府主管部門根據發明人或申請人的申請，認為其發明成果符合專利法規定的條件，而授予申請人或其合法受讓人的一種專有權。它專屬權利人所有，專利權人對其權利的客體（即發明創造）享有占有、使用、收益和處分的權利。

　　（2）具有時間性。所謂專利權的時間性，即指專利權具有一定的時間限制，也就是法律規定的保護期限。各國的專利法對于專利權的有效保護期均有各自的規定，而且計算保護期限的起始時間也各不相同。我國《專利法》第四十二條規定：“發明專利權的期限為20年，實用新型和外觀設計專利權的期限為10年，均自申請日起計算。”

　　（3）具有地域性。所謂地域性，就是對專利權的空間限制。它是指一個國家或一個地區所授予和保護的專利權僅在該國或地區的范圍內有效，對其他國家和地區不發生法律效力，其專利權是不被確認與保護的。如果專利權人希望在其他國家享有專利權，那么，必須依照其他國家的法律另行提出專利申請。除非加入國際條約及雙邊協定另有規定之外，任何國家都不承認其他國家或者國際性知識產權機構所授予的專利權。
