Some Inspection And Management Of Foreign Aid Materials In China

In order to further implement the measures for the management of foreign aid materials (Trial Implementation) (the national inspection and quarantine Federation (1998) 113rd) (hereinafter referred to as 113), and strengthen the inspection and management of foreign aid materials (hereinafter referred to as foreign aid materials), the relevant matters are hereby notified as follows:

1. The general contracting enterprises of all foreign aid projects must strictly examine the qualifications of the suppliers according to the provisions of article 113. Products that implement the export quality licensing system (such as mechanical and electrical products, chemical products), and health registration systems (such as food and animal products) must be procureed to the licensed enterprises and prohibited from purchasing in the market. The products without the export quality licensing system must first select the products that are certified by the China National Import and export enterprises Accreditation Committee (CNAB), followed by the products of the international quality system certification enterprises.

Two, resolutely implement the "origin inspection, port inspection" principle.

At the same time, taking into account the fact that some foreign aid materials are small in quantity and complicated in varieties, they are all procured from the manufacturers according to the principle of "origin inspection" and are reported to have practical difficulties in operation.

(1) all foreign aid materials that meet one of the following requirements allow general contracting enterprises to purchase in the market:

1. commissioned by the Ministry of foreign trade and economic cooperation general contracting enterprises to complete sets of projects to provide spare parts.

2. the total purchase price of a certain variety does not exceed RMB 100 thousand yuan, except for special circumstances specified in the bid document.

(two) where the above permitted foreign procurement materials are purchased, the goods must be inspected by the purchasing inspection and quarantine institution. The inspection items include: specifications, models, quantities, weights and packages, and the certificate of change is issued after inspection (excluding quality items); after the port is set up, the inspection and quarantine institutions on the shore shall conduct a unified inspection and issue the inspection certificate.

(three) in order to facilitate the distinction between manufacturer's procurement materials and market purchase materials in the inspection management, in the future, when the general contracting enterprises of foreign aid projects fill in the list of foreign aid materials inspection (hereinafter referred to as the checklist), the market purchase materials must be marked "market purchase" only in the list of inspection.

Three, all foreign aid materials (such as Western medicines, aircraft, ships, etc.) under the provisions of Document No. 113, which are "inspected by other inspection bodies in accordance with laws and administrative regulations", are not subject to special release. The general contracting enterprises of foreign aid projects must be submitted to other inspection bodies for inspection according to the principle of "inspection of origin", and they shall apply for inspection by the inspection and quarantine organs by the effective inspection certificate issued by other inspection institutions.

Four, where the imported goods are designated to be purchased domestically, the inspection and quarantine institution of the purchasing place shall produce the certificate of change after inspection of the appearance, packaging, quantity and weight of the goods, or directly submit the relevant formalities to the port inspection and quarantine agency by the qualified and effective import commodity inspection certificate issued by the entry-exit inspection and Quarantine Bureau.

Five, the materials that are granted special release according to the relevant management procedures (including the property rights under the complete set of foreign aid projects belong to the construction machinery of the general contracting enterprises of foreign aid projects and other materials that meet the special release requirements), and the Ministry of foreign trade and economic cooperation will issue a special release certificate to the inspection and supervision department of the State Administration for entry exit inspection and quarantine in a timely manner.

The inspection and supervision department will notify the relevant inspection and quarantine organs to exempt the inspection according to the special release certificate issued by the Ministry of foreign trade and economic cooperation, and send the notice of exemption to the Foreign Aid Department of the Ministry of foreign trade and economic cooperation.

The materials that have been inspected before the inspection notice is issued will still be handled according to the normal inspection procedures.

Six, the general contracting enterprises of foreign aid projects must strictly specify the inspection standards in accordance with the actual quality requirements approved by the aid and Foreign Affairs Department of MOFTEC. When any country or department has issued the standards, they must fill in the standard numbers, and the basic technical parameters and requirements of the standards must be specified in the industry standards or enterprise standards, so that the inspection and quarantine institutions must strictly implement the inspection.

Any change to the inspection list must be approved by the foreign aid and Foreign Affairs Department of the Ministry of foreign trade and economic cooperation, and the Ministry of foreign trade and economic cooperation shall notify the inspection and quarantine organ in the form of supplementary notice, otherwise, it will not be processed according to the inspection.

Seven, after receiving the award notice, the general contracting enterprises of foreign aid projects must take the initiative to liaison with the origin and port inspection and quarantine authorities, notify the manufacturers and stockings of the goods to be supplied, and make the inspection to the inspection and quarantine organs within the prescribed inspection places and time limits.

Eight, inspection and quarantine institutions must strictly enforce the provisions of Document No. 13, strictly control the quality of foreign aid materials, and establish a timely information feedback system.

In the future, inspection and quarantine offices of producing areas or purchasing places must not replace inspection certificates issued by port inspection and quarantine institutions, and port inspection and quarantine organs must not issue inspection certificates for foreign aid materials which are not in origin or where they are purchased and have no certificate of change.

If the inspection and quarantine institutions at all localities or ports are found to have failed to carry out the inspection of origin, inspection materials and the contents of the inspection notice, if the inspection materials fail to be inspected once and fail to meet the requirements of the inspection procedures, the inspection and Quarantine Bureau of the state entry exit inspection and Quarantine Bureau shall be immediately returned to the Ministry of foreign trade and economic affairs of the State Administration of entry exit inspection and quarantine for feedback.

Nine, the Ministry of foreign trade and economic cooperation will, in the future, settle accounts with the general contracting enterprises of foreign aid materials projects on the basis of inspection certificates issued by port inspection and quarantine institutions.

Ten, in order to facilitate the inspection and quarantine institutions to confirm whether they are foreign aid materials when carrying out the inspection, in the future, the general contracting enterprises of foreign aid projects must, when signing the internal purchase and sale contracts, uniformly mark the words "contracts for internal purchase and sale of the state aid projects". In the relevant clauses, the quality standards shall be specified in accordance with the inspection standards specified in the checklist, and the contents of the "inspection and quarantine institutions required to be inspected" shall be specified.

Eleven. The materials under the item of foreign aid joint venture cooperation special fund or the government discount interest loan item are inspected according to the normal export commodities, and temporarily executed according to the provisions of article 113.

The mission notification of such projects will no longer be issued by the State Administration for entry exit inspection and quarantine and its subordinate bureaus.

The above provisions shall be implemented from the date of dispatch, and the specific matters shall be contacted with the inspection and supervision department of the Ministry of foreign trade and economic cooperation and the State Administration for entry exit inspection and quarantine.
