Apple Corp pointed out that if the Dragon brothers buy China iPad trademark, they must bear the risk of purchase.
Because the purchase will be restricted by the Apple Corp's preferential rights and interests. The Dragon brothers will hold the iPad trademark of China in the form of trust, while the giant dragon brothers may also be involved in legal disputes with Apple Corp.
In addition, lawyers representing Shenzhen's Proview have denied any talks with the dragons brothers about the sale of China's iPad trademark.
Apple's embarrassment
"Last year, Apple Corp bought the iPad trademark of mainland China when it bought Taiwan iPad trademark."

Proview's dilemma

Shenzhen Proview, a middle-level newspaper disclosed to the newspaper that it was the agreement between Proview Hongkong and Apple Corp to sell the iPad trademark in Taiwan area. Now the iPad trademark in mainland China has been mortgaged to Shenzhen Minsheng Bank.
Although Shenzhen Proview can sell China's iPad trademark, the proceeds should also be used to repay bank debts.
In May 14th, Proview International announced that the court would sell the assets of Ningbo's wholly-owned subsidiary of the company, and the company will sell its assets on May 13th, 15 and 27 respectively, and the proceeds will be used to repay debts.
Yang Rongshan, chairman and chief executive officer of Proview international board, also said in the announcement that the reduction in overseas orders affected the supply chain operation of the company and the relationship between the company and its creditors.
The above information shows that Proview international is in an awkward position and has tight funds.
The reason why Apple Corp disputes with China's iPad trademark lawsuit is obviously to sell more money with China iPad trademark.
"The ownership of China's iPad trademark is not clear, and the Dragon brothers still have the opportunity to rob."
Liu Hui, partner lawyer of Guangdong Jun Yan law firm, pointed out that although Proview Hongkong and Shenzhen Proview belong to the company of Proview group, and even the legal representatives of the three companies are also Yang Rongshan, but Proview Hongkong has no right to sell Shenzhen Proview's assets, including the iPad trademark of China.
Because Proview Shenzhen has assets independence, its external debt is different, and it has the obligation to repay debts.
If Shenzhen Proview does not entrust Proview Hongkong to dispose of its assets, Proview Hongkong will not have the right to deal with the assets of Shenzhen's Proview company, including China's iPad trademark.
The above Shenzhen Proview middle level also confirmed that Shenzhen Proview has not yet decided on what price to sell China iPad trademark to Apple Corp.
Obviously, this result is not good news for Apple iPad, who is now preparing to enter China.
In May 12th, China Unicom (8.89, -0.15, -1.66%, economic and real time quotes) general manager Lu Yimin and Wang Jianzhou, chairman and chief executive of China Mobile (74.65,0.30,0.40%, economic and real time quotes), said at the shareholders' meeting that the company was discussing with apple about the possibility of iPad development.
However, the trouble that iPad will soon face is not just that.
"Even if Apple successfully takes the Chinese iPad trademark, iPad will still have the risk of appearance patent when it enters China."
Li Shaobao, the legal adviser of Shenzhen International Trade Promotion Association and deputy director of Shenzhen Baoan District enterprise assistance center, told the newspaper yesterday that the dragon company had applied for two patents of flat-panel TV appearance to the State Intellectual Property Office in June last year. Its appearance is basically the same as that of iPad.
Therefore, Apple Corp selling and producing similar iPad tablet computers in China will be regarded as infringing acts.
"Apple Corp should first eliminate the potential risks of iPad and not rush into the Chinese market."
