The Security Council, in August 4th, passed two notices on Approving the third party eligible assessment institutions to test products according to certain standards in August 4th. They were (1) testing clothes mainly for children aged 12 or below according to the flammability standard of clothing and textiles, namely, 16 1610th (16CFRpart1610) of the Federal code. (2) testing bedding, mattresses and mattress covers for children under 12 years of age or below according to the flammability regulation of mats.

According to the "Consumer Goods Safety Improvement Act", manufacturers of certain products (including importers) or private brands must submit products that are manufactured only after 90 days after the announcement of the inspection and certification provisions of the laboratory to the third party certification and accreditation bodies that have been accredited for testing, and must comply with the relevant compliance regulations according to the relevant test results.

The above circular will provide for the following provisions: (1) according to the flammability standard of clothing and textiles, namely, the title 16 1610th of the Federal Code, test children's clothing, and (2) test the children's mattress, mattress and mattress suit according to the flammability standard of mattress and mattress, namely, 16, 1632nd, and / or 1633rd of the Federal Code.

The third party laboratory must be accredited by the accreditation body to obtain the testing of the above child products, and the authorized institution must be the signatory of the international laboratory accreditation alliance mutual recognition arrangement, whose qualification is required to be registered with the consumer product safety committee and received.

Accreditation must conform to the ISO standard ISO/IEC17025:2005, and the scope of recognition must be specified for testing of flammability standards based on clothing, textiles, mattresses, mattresses and / or cushion sets.

If a laboratory has taken measures to prevent conflicts of interest, a training document must be submitted to the committee to prove that its employees have received training if employees are to be recognized.

Manufacturer

The private label or other interested parties try to conceal or interfere with the testing results of the laboratory, and notify the US consumer product safety committee in a confidential manner.

The additional provisions will be applicable if the children's products of the manufacturer or private brand are tested by the laboratory which holds the interests of 10% or more.

The application submitted by the laboratory must be formally accepted by the Committee. The laboratory can become a recognized laboratory which has adopted measures to prevent conflicts of interest.

In addition to the basic certification requirements, the Consumer Product Safety Improvement Act stipulates that

The laboratory owned or controlled by the government of the state; (2) the test results of the laboratory were not subject to improper intervention by anyone, including another government unit; (3) compared with other certified laboratories in the same country, the laboratory did not receive a more preferential treatment; (4) compared with the results of other certified laboratories in the same country, the government did not attach much importance to the test results of the laboratory; and (5) the laboratory did not interfere with other organs of the government on matters affecting its own operation, nor did it impose improper intervention on the decisions made by other government agencies responsible for controlling the distribution of products according to the results of the laboratory accreditation. Accreditation of laboratories wholly owned or partially owned or controlled can be recognized: (1) manufacturers or private brands operating in any country may, if feasible, be allowed to choose.

Even if the accreditation of the laboratory itself has not been accepted by the committee, the Commission will accept the accreditation issued by the laboratory for testing results.

The laboratory has been accredited by the signatories of the international laboratory accreditation union mutual recognition arrangement to comply with the ISO / IEC 17025 international standard.

The laboratory accepted the application of flammability standard test within 60 days after the notice issued by the Federal Register in the laboratory for testing and certification requirements.

The product is tested on the day after or after the announcement of the laboratory examination and certification requirements in the Federal Register.

In the course of testing, the effective certification category of the third party accreditation bodies clearly includes tests based on the flammability standards of clothing and textiles, bedding and mattress flammability standards, and / or the flammability of cushion sets (Ming Huo) standard.

The test results show that they are in line with the applicable standards and / or regulations.

Until the effective date of the mandatory third party certification, the two conditions of the laboratory's certification and the certification scope including flammability standards have been effective.
