"In the enterprises that we are cooperating with, some of the enterprises dispatched workers have accounted for 40% of the total number of workers. This 40% is only a proportion of employment with our company. It does not exclude these enterprises from cooperating with other companies at the same time."

Why do employers choose to employ large numbers of dispatched workers?

The director of human resources of many family businesses said that this is a misunderstanding outside, and the labor law has clearly stipulated that the formal employers are equal pay for equal work.
However, the dispatch of workers by labor has indeed saved the cost of recruitment.
"Formal employment unit pay and insurance are to be sent to the labor dispatch units, and also need to pay about 30% of the labor dispatch management fees, the total cost is not low."

Enterprises will pay wages, social security and overtime payments to labor dispatching companies, and then produce wages for labor dispatched workers.
However, reporters also learned that some irregular labor dispatching companies often make use of the defect of knowledge structure of dispatched workers, and the blind spot of legal knowledge does not deal with social security for their employees.
According to industry sources, the terms of social security are clearly stipulated in the labor contracts signed by labor dispatch companies and employees.
But the labor dispatch company will ask employees to submit another guarantee, which is guaranteed by the employees to give up social security, and will never be investigated in the future.
"In the final analysis, one is willing to fight and the other is willing to accept it."
This is very common in the industry.
The reporter telephoned Ren Yinhua, a lawyer for Hefei labor and work-related injury, said that he had encountered similar lawsuits before. Social security is the right of labor dispatched workers according to the labor law, and the "guarantee" submitted has no legal effect.
