Special Management Measures For Foreign Investment Access In Free Trade Pilot Area (Negative List)

1. The Special Administrative Measures for foreign investment access (negative list) in the free trade pilot area (hereinafter referred to as the "negative list of FTA") has been formulated according to the relevant laws and regulations, and has been approved by the State Council and is hereby promulgated. The negative list shows the special management measures for foreign investment access, which do not conform to the principle of national treatment. It is applicable to four free trade pilot areas in Shanghai, Guangdong, Tianjin and Fujian (hereinafter referred to as FTA).

Two. The negative list of FTA is divided into 15 categories, 50 entries and 122 special management measures according to the classification of national economy (GB/T4754 - 2011). Special management measures include specific industry measures and horizontal measures applicable to all industries.

Three. Pilot free trade zones The special management measures not listed in the negative list are related to national security, public order, public culture, financial prudence, government procurement, subsidies, special procedures and taxation, and shall be implemented in accordance with the existing provisions. Foreign investment in the FTA is related to national security. Foreign businessman The national security review pilot scheme shall be conducted for safety inspection.

Four. FTA pilot area Negative list In addition to the principle of consistency between domestic and foreign investment in the pilot area, the implementation guidelines should be issued by the provincial people's governments at the provincial level.

Five, investors in the Hongkong Special Administrative Region, the Macao Special Administrative Region and the Taiwan region will invest in the FTA pilot area with reference to the negative list of the FTA. The mainland and the Hongkong Special Administrative Region and the Macao Special Administrative Region on the establishment of closer economic partnership arrangements and their supplementary agreements, the framework agreement on economic cooperation across the Straits, and the free trade agreement signed by China in the FTA pilot area and for better opening measures to eligible investors, shall be carried out in accordance with the relevant agreements or agreements.

Six. The negative list of FTA will be implemented after 30 days from the date of issuance and timely adjustment.

On behalf of the Macao SAR government, Cui Shian expressed support for the implementation of the principle of "one country, two systems" by the Fujian provincial Party committee and the provincial government, and attaches great importance to the cooperation between Fujian and Macao and actively supports the development of the Macao Special Administrative Region. He said that Macao and Fujian are close geographically and are closely related to each other. The friendly contacts between the two countries are deep rooted, and the fruits of cooperation are constantly emerging.
