The following production and operation activities shall be registered: land and offshore oil and other mineral resources exploration and development; construction, decoration or line, pipeline, equipment installation and other engineering contracting; contracting or accepting entrusted management and foreign investment enterprises; foreign banks set up branches in China; other production and business activities permitted by the state.

According to the second provision of the People's Republic of China State Administration for Industry and Commerce on the registration and management of foreign and regional enterprises' production and operation activities in China, foreign enterprises should apply for registration with the State Administration for Industry and commerce or the local industrial and Commercial Administration authorized by the State Administration for Industry and commerce when they apply for registration.

The decision of the State Council on the cancellation and decentralization of a number of administrative examination and approval items promulgated in May 15, 2013 clearly defined the approval of foreign (regional) enterprises to engage in production and business activities in China, which was delegated to the Provincial Administration for Industry and Commerce by the General Administration of industry and Commerce.

The draft also makes clear that when applying for registration, a foreign enterprise shall submit an application signed by the chairman or general manager of a foreign enterprise and the approval document or certificate of the examining and approving organ, and shall apply to the registration authority for registration for registration within 30 days from the date of approval by the examining and approving organ.
