How to deal with more and more infringement cases? Since 2008, with the strong promotion of market copyright protection, Keqiao Textile City has formed the "four in one" intellectual property protection system with "registration protection as the basis, administrative protection as the dominant, judicial judgment as protection and industry self-discipline as supplement".

We have a "talent pool" consisting of business households and industry experts. There are nearly 50 talents.

Experts who participated in the infringement judgment were randomly selected from the "talent pool".

However, how to identify pattern infringement has always been the core and difficult problem of copyright disputes. Some similar patterns are sometimes difficult to identify with the naked eye.

In order to solve this problem, the "pattern office" launched the first digital screening system in China, and jointly established and promulgated the first domestic copyright infringement identification standard in China.

We set up a model trading area for pattern copyright protection in China Textile City, cultivating and developing more than 10 intermediary service agencies to guide the acceleration of copyright protection.

At the same time, the Keqiao district government also formally issued the "China Textile City's textile pattern similarity recognition standard", from the administrative review, expert review, public assessment three levels of similarity to identify.

Although the copyright protection environment is constantly optimized and the copyright awareness of textile enterprises is getting stronger and stronger, departments are constantly trying to better protect original works, but infringement cases still occur frequently.

"The process of safeguarding rights is too long, and the punishment for infringing acts is not big enough. After being checked, they usually investigate and punish infringing goods, so the cost of infringement is not high, and violations are repeated."

Private enterprises explore: original protection platform, fast and authoritative rights protection

In the private sector, textile enterprises in Keqiao also voluntarily participate in the protection team.

Shaoxing original color digital technology Co., Ltd., jointly with the Shenzhen creative design Intellectual Property Promotion Association, has jointly developed the "Chinese textile pattern original protection public platform".

"Original color digital" is a hi-tech enterprise specializing in pattern design, computer color separation, digital printing, color separation software and digital equipment research and development. Originality is the soul of the company.

"Textile design has the characteristics of short cycle and fast updating. Because of the long period of copyright registration and the long patent application period, the cost of the original textile design is not high enough to protect the original textile patterns, which has affected the initiative of the whole industry."

Zhang Weihai, director of "primary color digital", talked about the original intention of developing the original protection platform for textile patterns.

"The public platform for the original protection of Chinese textile patterns is set up in Shenzhen digital works record center, which is the only original public protection platform in China.

The record center adopts the cooperation mode of government presiding, Association certification and enterprise operation, that is to say, the copyright certificate obtained on the "Chinese textile pattern original protection public platform" is authoritative, and the work record has legal effect.

As long as you register with the ID card on the platform, verify the identity from the backstage, fill in the archival information, submit your original works, then you can complete the registration after the original identification of the work by the system, and get the original work record electronic certificate.

This electronic certificate has legal effect in the whole country. If the registered flower type is infringed, this certificate can be taken as the basis for safeguarding rights.

"In the past, it takes about 2-3 days to apply for the original. The whole process of this platform will take a few minutes, and the application fee will be much cheaper. The registration fee of an original flower form is no more than 50 yuan.

If there is a tort problem, the platform also has a discerning system for judging whether the infringement is committed, as well as a counsel help group, specially providing advice such as pattern infringement disputes.

Zhang Weihai said that at present, the platform is in the testing period, and will soon face the market. The copyright proof will be obtained at the same time when the work is completed, which will be more conducive to copyright protection, paction and use of the works.
