Be Careful About The Time Of Trademark Registration

Within 3 months after the application, the notice of acceptance will be received within 3 months after the application is filed.

The 6 months after the acceptance of the trademark is the notice period of the preliminary examination. At this point, the Trademark Office has passed the preliminary examination of the trademark and issued a preliminary notice of the trademark to the public.

If the trademark fails to pass the preliminary examination, the notice of rejection will be issued to the applicant.

After the adoption of the first instance, a 3 month dissenting period is passed. Any prior obligee or interested party considers that if the trademark infringes its exclusive right to use the trademark, it may raise objection to the Trademark Office and take the trademark objection process.

If a trademark passes smoothly through the first instance and no objection is raised, the successful registration will be successful, and the Trademark Office will issue a trademark registration certificate later. If the trademark fails to pass the preliminary examination, the Trademark Office will issue a notice of disqualification to the trademark applicant 9 months later. The business jury should make a decision on rejecting the review within 9 months. If there is any special case, it can be extended for 3 months.

If the review fails, the applicant may bring a lawsuit to the court within 30 days.

Any interested party or the prior obligee may raise objections to the trademark that has been adopted by the first instance within 3 months of the trademark notice period.

The Trademark Office shall make a decision on the trademark objection within 12 months after the announcement period, and may extend it for 6 months in case of exceptional circumstances.

If the trademark objection is successful, the trademark applicant may make an objection to the Business Review Committee within 15 days.

The commercial jury should decide on the trademark objection review within 12 months, and the special case can be extended for 6 months.

If the objection fails to be reexamined, the trademark applicant may bring a lawsuit to the people's court within 30 days from the date of receiving the notice.

Four. Trademark invalid declaration

If a trademark owner receives a notice of invalidation of a trademark, he may apply for a trademark review within 15 days. The Business Review Committee shall make a decision in 9 months for reexamination. If there is a special case, it can be extended for 3 months. If the failure of the review is made, all persons may bring a suit in the people's court within 30 days from the date of receipt of the notice.
