    The Decree No. 226th of the State Council of the State Council of People's Republic of China has released the regulations on running schools for social forces, which will come into force on October 1, 1997.

    People's governments at all levels should strengthen leadership over the operation of social forces and incorporate social forces into the national economic and social development plan.

    The fifth social forces should focus on the implementation of vocational education, adult education, higher secondary education and preschool education institutions.

    The State encourages social forces to hold educational institutions that carry out compulsory education as a supplement to the implementation of compulsory education in the state.

    The state strictly controls the social forces to hold institutions of higher education.

    Social forces must not hold religious schools or disguised religious schools.

    Sixth social forces hold educational institutions, not for profit purposes.

    Seventh organizations or individuals shall not apportion educational expenses to enterprises, institutions and individuals under the name of social forces running schools.

    Eighth countries guarantee the legitimate rights and interests of educational institutions held by social forces.

    Educational institutions organized by social forces are entitled to autonomy in running schools according to law.

    Educational institutions organized by ninth social forces should abide by laws and regulations, adhere to the socialist orientation of running schools, implement the educational policy of the state, and guarantee the quality of education and teaching.

    Educational institutions and their teachers and students, organized by tenth social forces, enjoy equal legal status with educational institutions, teachers and students held by the state.

    Eleventh State Council education administration departments are responsible for the overall planning, comprehensive coordination and macro management of the national social forces running schools.

    The education administrative department, labor administrative department and other relevant departments under the State Council shall be responsible for the running of the relevant social forces within the scope of duties prescribed by the State Council.

    The relevant departments of the local people's governments at or above the county level are responsible for the running of the relevant social forces in accordance with the responsibilities prescribed by the people's governments of provinces, autonomous regions and municipalities directly under the central government.

    Twelfth organizations and individuals who make outstanding contributions to the running of social forces are rewarded.

    In the second chapter, the establishment of educational institutions in the thirteenth chapter, the units that apply for educational institutions should have the legal person qualification. The individuals who apply for educational institutions should have political rights and full civil capacity.

    Examination institutions such as the national education examination, the vocational qualification examination and the technical rank examination shall not hold educational institutions related to their examination business.

    The fourteenth set up educational institutions should have the basic conditions stipulated in the education law and the vocational education law.

    The seventeenth examination and approval institutions should be based on the conditions and standards of educational institutions, and meet the requirements of national interests and public interests as well as the reasonable structure and layout of education.

    When applying for educational institutions to implement academic education, the examination and approval machine will accept the application before the third quarter of each year and reply in written form before the end of second April. If the application for other educational institutions is to be held, the examination and approval authority shall reply in writing within 3 months from the date of accepting the application.

    The eighteenth examination and approval organs issue educational licenses to educational institutions approved by the government.

    The school running permit shall be formulated by the education administrative department under the State Council, and the educational administrative department and labor administrative department under the State Council shall organize printing separately according to their respective duties.

    After obtaining educational license, educational institutions should register the administrative rules and regulations of non enterprise units in accordance with relevant social forces before carrying out education and teaching activities.

    Nineteenth educational institutions shall not set up branches.

    The names of the twentieth educational institutions should be specified in terms of their categories, levels, and administrative regions. Without the approval of the administrative department of Education under the State Council or the labor administrative department in accordance with the division of responsibilities, they should not be labeled "Zhonghua", "China" or "international".

    The third chapter is the teaching and administrative management of educational institutions. Twenty-first educational institutions can set up school boards.

    The School Council proposes the selection of principals or principals, and decides on major issues such as the development of educational institutions, financing and budgetary accounts.

    The school board is composed of representatives of the organizers or representatives, staff of educational institutions, and people who are enthusiastic in their education and conduct. Among them, more than 1/3 directors should have more than 5 years' experience in education and teaching.

    The first directors are elected by the organizers, and the later directors are elected according to the rules of the board of directors.

    The director shall be appointed after approval by the examining and approving organ.

    The state's current staff members shall not serve as directors of educational institutions at the same time, except for special needs, appointed by the people's government at or above the county level or by the relevant departments.

    Twenty-second principals or chief executives of educational institutions are responsible for teaching and other administrative work.

    The terms of appointment of principals or principals of educational institutions should be carried out according to the qualifications of the principals or principals of similar educational institutions held at the same level, but the age can be relaxed appropriately.

    The chairman of the education institution or the chief executive officer of the education institution shall be appointed by the Council. The school council will be appointed by the sponsor and approved by the examination and approval authority.

    The twenty-third family members who serve as directors, principals or principal executives of educational institutions and persons serving as general affairs, accountants and personnel positions carry out family avoidance system.

    Teachers and other educators in the twenty-fourth educational institutions have the right to establish trade union organizations in accordance with the trade union law and safeguard their legitimate rights and interests.

    The twenty-fifth educational institutions independently appoint teachers and other educators according to the relevant regulations of the state.

    Teachers appointed by educational institutions should conform to the qualifications and qualifications of teachers prescribed by the state.

    Educational institutions should strengthen their political and ideological education and professional training for their appointed teachers.

    Teachers engaged in educational institutions and other educators should sign employment contracts with them.

    The appointment of foreign teachers by educational institutions shall be handled in accordance with the relevant regulations of the state.

    Twenty-sixth educational institutions independently recruit students according to the relevant regulations of the state.

    The admission rules and advertisements of educational institutions must be examined by the examination and approval authorities before they can be issued.

    Educational institutions will recruit overseas students in accordance with the relevant regulations of the state.

    The twenty-seventh educational institutions independently decide the professional setting according to the relevant regulations of the state.

    The teaching contents of the twenty-eighth educational institutions should conform to the provisions of the constitution, laws and regulations.

    The primary and secondary schools held by the social forces should implement education and teaching in accordance with the requirements of the educational administrative departments under the State Council and the curriculum plans and syllabuses formulated by the educational administration departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government. The textbooks selected should be examined and approved by the educational administration departments of the people's governments of the provinces, autonomous regions and municipalities directly under the central government.

    The twenty-ninth educational institutions should make full use of social public educational facilities, equipment and materials, and make full use of the role of radio and TV universities and radio and TV schools to carry out education and teaching activities, and improve the quality of education and teaching.

    The thirtieth educational institutions should establish and carry out the management system of student status and teaching in accordance with the relevant regulations of the state.

    Thirty-first students who have approved the implementation of academic credentials education and completed their studies and pass the examination are awarded academic certificates by their schools in accordance with the relevant regulations of the state.

    Students from other educational institutions completed their studies, and issued training certificates or other academic certificates from their educational institutions, marking their courses and examination results, and participating in the vocational qualification examination or technical grade examination according to the relevant state regulations.

    The thirty-second educational institutions engrave seals, which shall be examined and approved by the public security organ of the people's government at or above the county level, with the certificate of school running and the certificate issued by the examining and approving organ.

    Educational institutions should submit their seals to the examining and approving organs and public security organs for the record.

    Thirty-third administrative departments, labor administrative departments and other relevant departments should strengthen supervision and management of social forces in running schools.

    Local people's governments at or above the county level should strengthen supervision and evaluation of the educational level and educational quality of educational institutions in their administrative areas.

    No administrative department shall supervise the management of educational institutions.

    The fourth chapter is the property management and financial management of educational institutions. Thirty-fourth educational institutions should establish financial, accounting and property management systems in accordance with the law, and set up accounting books in accordance with the provisions of the accounting system of administrative institutions.

    Thirty-fifth educational institutions collect fees according to the relevant regulations of the state.

    The charging items and standards of educational institutions are put forward by the educational institution, and the opinions are put forward by the examining and approving bodies. The financial departments and price management departments are responsible for the division of labor according to their duties, and are approved according to the education, teaching cost and the actual situation of receiving funds.

    Thirty-sixth educational institutions can manage and use their property according to law, but they must not be pferred or used for security.

    No organization or individual can encroach on the property of educational institutions.

    The thirty-seventh educational institutions should determine the proportion of salaries and welfare expenses of all kinds of personnel to the regular school expenses and submit them to the examination and approval authorities for the record.

    The accumulation of educational institutions can only be used to increase investment in education and improve the conditions for running schools. It should not be used for distribution, nor for investment outside school.

    The thirty-eighth educational institutions should produce financial and accounting reports at the end of each accounting year, and entrust the social audit institutions to audit their financial and accounting status according to the requirements of the examination and approval authorities, and report to the examination and approval authorities for examination.

    In the fifth chapter, the change and dissolution of educational institutions in the thirty-ninth chapter of education institutions should be submitted to the examination and approval authorities for approval.

    The merger of fortieth educational institutions should be carried out for property inspection and financial settlement, and the merged educational institutions shall properly relocate the original school students.

    When the educational institutions that implement compulsory education are dissolved, the examination and approval authorities shall arrange compulsory education in schools.
