According to the provisions of the anti dumping regulations of the People's Republic of China, the Ministry of Commerce issued a notice on filing in November 14, 2008, and decided to investigate the anti dumping sale of imported polyamide -6,6 chips originating in the United States, Italy, the United Kingdom, France and Taiwan. The product under investigation is in the tariff code of import and export tariff of People's Republic of China: 39081011.

According to the findings of the investigation and the twenty-fourth provision of the anti dumping regulations of the People's Republic of China, the Ministry of Commerce has made preliminary rulings (see Annex). The relevant matters are hereby announced as follows:

I. preliminary ruling

The Ministry of Commerce initially ruled that during the investigation period, it originated in the United States, Italy, the United Kingdom, France and Taiwan. Imported polyamide The dumping of -6,6 chips has caused substantial damage to the polyamide -6,6 chip industry in mainland China, and there is a causal relationship between dumping and material damage.

According to the provisions of the twenty-eighth and twenty-ninth provisions of the People's Republic of China anti dumping regulations, the Ministry of Commerce decided to implement temporary anti-dumping measures in the form of margin. Since June 26, 2009, when importing operators import polyamide -6,6 chips originating in the United States, Italy, the United Kingdom, France and Taiwan, they shall provide corresponding guarantee to People's Republic of China customs according to the dumping margin of the companies determined by the preliminary decision.

The specific description of the product under investigation is as follows:

The name of the product investigated: polyamide -6,6 chip, full name polyhexyl two hexamethylene diamine (Polyamide-6,6).

Chemical formula: [NH (CH2) 6-NH-CO- (CH2) 4-CO]n

Physicochemical characteristics: translucent or opaque creamy white crystalline polymer.

Main application: polyamide -6,6 chip is a synthetic resin, widely used in injection molding, spinning, modification, etc., and is applied in electronic and electrical appliances, military industry, automobile, railway fittings, textile and other fields.

The product is classified in the People's Republic of China import and export tariff code: 39081011. The modified polyamide -6,6 chip (referred to as "modified polyamide -6,6 chip") with two times mixing of glass fibers, minerals, toughening agents and flame retardants is not included in the product under this tax code. The modified polyamide -6,6 chips are toughened, reinforced, flame retardant and filled. The density of toughened modified polyamide -6,6 chips is less than 1.12 grams / cubic centimeter. The density of reinforced, flame retardant and filled polyamide -6,6 chips is higher than 1.15 grams / cubic centimeter.

Three. Levy Bond Method

Since June 26, 2009, when importing operators import polyamide -6,6 chips originating in the United States, Italy, the United Kingdom, France and Taiwan, they shall provide corresponding certificates of deposit to the People's Republic of China customs according to the dumping margin of the companies determined by the preliminary decision. The deposit is calculated at the customs value of the customs value approved by the customs. The formula is: margin amount = (customs examination paid tax rate * margin collection ratio) * (1+ import duty increment tax rate).

Four, commentary

Within 20 days from the date of promulgation of this notice, the interested parties may submit written comments and relevant evidence to the Ministry of Commerce, and the Ministry of Commerce will consider them in accordance with the law.
