The national development and Reform Commission announced 13 days that it had studied and drafted the special provisions on the punishment of price violations during the period of abnormal market price fluctuations (Draft).

People concerned with the development and Reform Commission pointed out that the reason for studying the drafting of the regulation is mainly due to the fact that this year, a few operators in some places fabricate and disseminate information on price increases and malicious hoarding.

"The main purpose of the proposal is to stop and severely punish price violations in the period of abnormal price fluctuations, manage inflation expectations and stabilize the overall price level."

It is pointed out that the abnormal fluctuation of market prices of important commodities (including services) may have a major impact on the lives of the people and the production of enterprises. With the approval of the competent department of price under the State Council or the people's governments of provinces, autonomous regions and municipalities directly under the central government, the competent price departments may investigate and punish the illegal acts of price according to these provisions.

In terms of specific penalties, the opinion points out that fabricating and distributing business operators.

If other units or individuals fabricate or disseminate price hikes and disturb the market price order, they shall be ordered to make corrections, and the unit shall be fined 100 thousand or more yuan less than 1 million yuan, and a fine of 10 thousand yuan or more yuan less than the personal department. If the circumstances are serious, the authorized organ shall revoke the license and license in accordance with the law, or cancel the registration.

The opinion stipulates that the market for operators

If a business operator has doubled the price of production, marketing or sales, exceeding the normal price difference, it shall be ordered to make corrections, confiscate the illegal gains, and impose a fine of not more than 5 times the illegal income; if there is no illegal income, it shall be fined not less than 200 thousand yuan or less than 2 million yuan; if the circumstances are serious, it shall be ordered to suspend business for rectification, or the administrative department for Industry and Commerce shall revoke the business license in accordance with the law.
