Land Management Law Postponed

The eleven session of the country in December 13th

The current land management law was promulgated in 1986, and has been modified three times in 1988, 1998 and 2004.

In 2008, the legislative plan of the eleven NPC Standing Committee was included in the draft for consideration during its term of office.

The qualification of collective construction land entering the market is one of the problems that need to be solved in the land management law.

According to the relevant provisions of the current land management law, the collective construction land must be expropriate by the government as a state owned enterprise, so that it can qualify for market pfer.

This led to repeated prohibition of small property rights housing and frequent cases of housing demolition on collective land.

In order to break through this restriction, local governments such as Chengdu and Chongqing have made some reforms in recent years, but so far they have not been legally recognized.

In 2009, the Ministry of land and resources drafted a draft for consultation, which adjusted the content of the compensation standard and scope of levy, but was criticized by the academic circles because it did not respond to the problem of collective land entering the market which was most concerned.

According to the report of the financial and Economic Committee adopted by the eleven National People's Congress at the seventeenth session of the people's Congress on the consideration of the motion submitted by the presiding Committee at the third session of the NPC, the legislation on housing demolition in collective land expropriation will be considered in the land management law.

The most notable draft of this conference is the amendment to the criminal law (eight). Its draft was first considered at the sixteenth session of the Standing Committee of the eleven National People's Congress held in August 23rd.

A total of 46 amendments to the draft first instance were included, including the abolition of 13 economic non violent crimes.

According to "finance and economics" reporter understands, the second instance draft will increase the food safety aspects.
