Vietnam Announcement Aggravates Administrative Penalties For Violations Of Trade Activities

In December 1st (2010), the Vietnamese government issued Notice No. 112/2010/ND-CP to amend the Announcement No. 06/2008/ND-CP of the government on January 16, 2008.

Trade

The administrative sanctions for certain provisions of the activities will include some administrative penalties for violating the provisions of trade activities as follows:

1. For those who operate contraband goods from above 70 million to 100 million or below, they will be fined from 20 million to 30 million plus (1500 to 20 million). If the value of contraband exceeds 100 million above the shield, they will be fined from 30 million to 35 million.

Two, for those who operate on the value of 30 million above the shield but not to be prosecuted, they will be fined from 20 million to 30 million.

Three, for the production of food, food, medicine, feed, fertilizer, animal medicine, animal and plant seedlings and other imitations; processing, production, allocation, assembly, reproduction, works, classification, packaging, packaging and import.

Imitation

Those who are not prosecuted shall be punished by a penalty of 2 times the amount of the penalty.

The announcement of 112/2010 will start in February 1st next year and abolish the twelfth Announcement No. 107/2008/ND-CP of the government in September 22, 2008.

Trade

The administrative sanction of fraud and other acts shall be abolished, and the provisions on Administrative Measures for violation of weights and measures and quality standards of goods shall be abolished in articles twenty-third, twenty-fourth and 25 of the Announcement No. 54/2009/ND-CP of June 5, 2009.
