In November 16, 2010, Zhangjiagang Jin Du Knitted Garment Co., Ltd. declared to export customs goods from Shanghai to Waigaoqiao port area customs. When customs examination officers checked the ticket declaration, they were sensitive to the risk of infringement.
The Shanghai customs inspected the goods and found that the actual export goods were 9279 sets of cotton knitted women's sports suits marked with the "JUICY" brand, 2336 sets of knitted men's sports suits marked with "PUMA and graphic" trademarks, 4843 knitted cardigan knitted with "THENORTHFACE and graphic" trademarks and a total value of about 1 million 120 thousand yuan. Through contact with the right holder, the "JUICY" trademark holder, the US L.C. Chartered Company, the "PUMA and graphic" trademark holder, German Rudolf Das Le sporting goods, Bo Ma joint stock company, "THENORTHFACE and graphic" trademark rights holder, the US The North Face Apparel Corp confirmed the cargo infringement.
Shanghai customs in the investigation of the case found that the ticket goods Zhangjiagang City Kim Du Knitted Garment Co., Ltd. was commissioned and exported by ANDYKIM, a Korean customer of the United States. The customer provided the knitted sports suit with "PUMA and graphic" trademark, the knitted cardigan with "THENORTHFACE" trademark, and the sample of the cotton knitted sports suit marked with "JUICY" brand. The customer asked Zhangjiagang city Zhangjiagang Knitted Garment Co., Ltd. to produce samples according to the sample, then exported to the United States, and received and cleared the goods from the US RARECONCEPTINC in the United States. Zhangjiagang City Kim Du Knitted Garment Co., Ltd. produced and exported the above goods according to its requirements.
