Online Shopping Legislation Is Expected To Be Enacted Within The Year
In April 2nd, the State Administration for Industry and Commerce (DRC) drafted the Interim Measures for the management of online commodity trading and related services (Draft for Soliciting Comments), and began to solicit opinions from the public.
The public can make comments and suggestions to the relevant departments before April 21st.
It is reported that this management method that affects the development of the network economy is expected to be formally promulgated and implemented during the year.
"This soliciting draft shows that the state is highly concerned about e-commerce, and the legislation reflects the government's support and encouragement for the development of online shopping."
Zhang Yong, chief financial officer of Taobao, the largest online retail business in Asia, told China's "China made news" reporter.
The Interim Measures stipulate that natural persons who engage in commodity trading and related services through the Internet shall apply to the operators providing network paction platform services and submit their real names and addresses.
Those who have the conditions of registration shall go through the registration of industry and Commerce in accordance with the law.
Operators who provide network paction platform services shall examine and register the real identity information of natural persons who are not eligible for business registration conditions, apply for natural products or services provided by the network trading platform, establish registration files and regularly verify updates.
At present, online shopping has been accepted and recognized by more and more consumers.
According to the research report released by China Internet Network Information Center, the number of Chinese online shopping users reached 108 million passengers in 2009, and the annual online shopping market scale exceeded 250 billion, double the growth rate in 2008.
The scale of pactions accounted for nearly 2% of the total retail sales of social consumer goods in the whole country.
E-commerce is becoming the first choice for people's daily consumption because of its advantages such as convenience, shortcut, payment security, reduction of intermediate links and consumer spending.
At present, online shopping has become the mainstream lifestyle of the mainstream Chinese population.
At the same time, e-commerce has brought a lot of employment opportunities to the society.
Open shop has less investment, convenient operation and low risk, and has become an important way of employment.
However, in the process of reform and opening up, China's relevant laws and regulations are not perfect, especially in e-commerce. The speed of economic development leads people to "cross the river by feeling the stones".
In other words, compared with the Internet trade, China's regulations are still blank in the management of online pactions.
Because of the particularity of online shopping platform, most of these disputes are difficult to deal with.
Although some leading online shopping platforms have established an effective credit and consumer protection system, they still need the promotion and promotion of national legislation.
"In this case, it is more and more important to make the legal system sound as soon as possible. Only in this way can we really regulate the online shopping industry."

In fact, in recent years, Beijing, Shanghai and other regions have issued some corresponding local laws and regulations, which regulate the online shopping, but they are mainly based on the principles, and lack specific protective measures and penalties.
In the case of online shopping disputes, it is mainly handled according to the contract law, the consumer rights protection act, the product quality law, and the state's "Three Guarantees" regulations.
Only by establishing network trading supervision mechanism and corresponding regulations can we ensure the healthy development of network pactions.
The "three fixed" plan of the State Council gives the industry and commerce administration organs the function of supervising network pactions.
Zhang Yanping, senior analyst at the domestic advisory body, said that the publication of the management measures (Draft) is good news for China's Internet market.
For the first time, the concept and responsibilities and obligations of online commodity operators and network service operators are clarified. They will play a positive role in standardizing network commodity pactions and guaranteeing the interests of consumers.
Compared with the previous policies and regulations on e-commerce, this management method focuses more on the norms and constraints in actual pactions, and is more practical.
