In accordance with the provisions of the foreign trade law of the People's Republic of China and the regulations on the administration of the import and export of goods in People's Republic of China, we hereby issue the catalogue of goods exported for export license in 2010 (see Annex 1) and make the following announcements on the following issues:

49 types of export license management implemented in January and 2010

(1) the commodities for export quota permit management are: corn, rice, wheat, corn flour, rice flour, wheat flour, cotton, sawn timber, live cattle (to Hong Kong and Macao), live pigs (to Hong Kong and Macao), live chickens (to Hong Kong and Macau), coal, coke, crude oil, refined oil, rare earth, antimony and antimony products, tungsten and tungsten products, zinc ore, tin and tin products, silver, indium and indium products, molybdenum and phosphate ores.

(two) the goods for bidding for export quotas are: Rush grass and rush products, silicon carbide, talc block (powder), light (heavy) magnesia, bauxite, licorice and so on.

(three) the goods under the management of export license are: live cattle (outside the market for Hong Kong and Macao), live pigs (for markets outside Hong Kong and Macao), chilled beef, frozen pork, frozen chicken, frozen chicken, ozone depleting substances, paraffin, zinc and zinc based alloys, some metals and products, platinum (processed in trade), automobiles (including complete sets of spare parts) and their chassis, motorcycles (including all terrain vehicles), their engines and frames, natural sand (including standard sand), molybdenum products, limonic acid, vitamin C, penicillin industrial salt, and sodium sulphate two.

Two, the management of quota permits for cattle, live pigs and live chickens exported to Hong Kong and Macao should be carried out under the global license. In addition to the export permit management of natural sands exported from Hong Kong, Macao and Taiwan, other regions shall prohibit export, and the standard export of standard sand shall be managed by the global export license.

Four. In any trade mode, goods licensed for export quota shall be issued on the basis of the list of successful enterprises issued by the Ministry of Commerce and the number of successful tenders, and the certificate issued by the bidding Office for the export licence of the bidding goods.

Five, the export of the following goods by way of processing trade shall be handled according to the following provisions:

(1) in addition to the provisions of subparagraphs (two), (three), (four) and (five) of this article, export commodities which are managed by export quota permits shall be exported by way of processing trade. The license issuing agencies shall issue export licenses on the basis of export quotas, processing trade approval certificates and export contracts (original copies).

(two) to import platinum (platinum or platinum) for the processing of raw materials for the production of platinum, the issuing agency issued an export license on the basis of the "approval certificate for processing trade business", the customs processing trade import declaration form and the export contract (copy of the original copy) of the business competent department of the business enterprise.

(three) import of crude oil for processing reexports of paraffin wax, import of silver containing goods (silver powder, non forging silver, etc.) and silver semi manufactured goods, processing of silver for export, export of zinc and zinc based alloys in processing trade, and certification authority issuing export license with processing trade approval certificate, customs processing trade import declaration form, export contract (original copy), by the provincial commerce department of the registered enterprise.

Among them, the approval certificate of processing trade business is issued by the Ministry of Commerce, and the issuing department is approved by the Ministry of Commerce.

(four) export licorice and licorice products in the form of processing trade. The certification authority shall issue the export license according to the "processing trade approval certificate" of the provincial commerce department at the place where the enterprise is registered, the certificate for processing trade goods export license issued by the chamber of Commerce of the import and export of Chinese medicines and health products, the import and export declarations of customs processing trade and the export contract (original copy).

(five) import of crude oil for processing of re exported products without the license for export of finished oil.

The export of lube (grease) and lube base oil under processing trade shall be carried out in accordance with the relevant provisions of the Announcement No. thirtieth of the Ministry of Commerce, the development and Reform Commission and the General Administration of Customs in 2008.

(six) the validity period of the export license mentioned in (1), (two), (three) and (four) of this article shall be issued according to the export period approved by the processing trade approval certificate, but shall not exceed December 31st of that year.

If the export period approved by the processing trade approval certificate exceeds December 31st of the year, the operator should issue a new export license to the certification authority within the validity period of the original export license. The certification authority will recover the original certificate and cancel the original certificate in the license issuing system. After deducting the quantity used, the new export license will be re issued according to the export period approved by the processing trade business approval certificate, and the original certificate number should be indicated in the remarks column.

Six, in accordance with the spirit of the State Council's "Circular on related issues on border trade" ([1996]2), small quantities of export commodities, ozone depleting substances, automobiles (including complete sets of spare parts) and their chassis, motorcycles (including all terrain vehicles) and their engines and frames will be handled by the small border trading enterprises, and the export licenses shall be handled by the licensing authorities authorized by the Ministry of Commerce.

Where the export license management goods (Annex 2, category 1-28) of the border small trade enterprises belong to the management of export quota permits, the competent departments of Commerce of the frontier provinces and autonomous regions authorized by the Ministry of Commerce shall issue export licenses according to the export quota of the border trade issued by the Ministry of commerce.

Except for the goods listed in the 2010 export licensing management catalogue, the export of small frontier trading enterprises shall be exempted from export licenses.

Seven, in order to ensure the implementation of the online verification and cancellation of import and export licenses, the issuing agencies must fill in the "remarks" column of the permit "no one batch and one certificate" when issuing the export licenses.

The goods that are managed by "no one batch and one certificate" are:

(1) exporting goods by foreign invested enterprises;

(two) processing trade means export goods;

(three) export commodities under compensation trade;

(four) rice, corn, wheat, live cattle, live pig, live chicken, beef, pork, chicken, crude oil, refined oil, coal, automobile (including complete parts) and its chassis.

The export license of "no one batch and one certificate" can be declared several times at the same port, but not more than twelve times.

After the twelve declaration, although the export license has a balance, the customs will not accept the declaration.

Eight, advertising goods with ozone depleting substances must be exported on the basis of export licenses.

Nine, enterprises must export licenses for export of automobile products by means of general trade, processing trade, border trade and donation trade. Enterprises should apply for export licenses for export of automobile products by way of engineering contracting, but they are not subject to the management of export qualification.

Ten, the Catalogue Products provided by our government under foreign aid are not included in the quota and license management.

This catalogue has been implemented since January 1, 2010.

The catalogue of goods for export license management in 2009 shall be abolished at the same time.
