152 Spring Companies Involved In "Two Counter Two Guarantees" New Case Experts Teach Good Plan

Under such a big background, experts from the Ministry of Commerce and famous lawyers recently came to Quan to give good advice to help enterprises cope with the increasingly high international trade barriers.

Reporters learned from Quanzhou foreign trade and Economic Cooperation Bureau, compared with previous years, the number of enterprises involved in trade friction increased significantly this year, an increase of 169% over the previous year.

For example, Mexico has imposed a minimum price on footwear in China, and Brazil has imposed a 182% anti tax avoidance effect on Chinese shoes. The pmission effect is very obvious.
Brazil has imposed an anti-dumping duty of $13.85 per pair on imports of Chinese shoes in 2010. After the tax was levied, the average sales cost of each pair of shoes increased by 100 yuan, which has greatly affected Quanzhou's footwear exports to Brazil, and many enterprises have dropped out of the Brazil market.

The export of products to Brazil reached a record high of 13 million 460 thousand US dollars, and explosive growth occurred before the anti-dumping tax levy, an increase of 243% over the same period last year. After a sharp fall in anti-dumping investigations, it exported only 1 million 110 thousand US dollars in 2009, down by 92%, down to 206 thousand US dollars in 2010, only 167 thousand US dollars in 2011, and 2 in export enterprises.
In order to avoid high anti-dumping duties, some export enterprises have to continue to export through semi-finished products export and assembled in third party countries or in Brazil. However, as Brazil has imposed 182% anti tax avoidance on shoes, this method has not worked. Quanzhou footwear basically withdrew from the Brazil market.

Earlier, after the government and enterprises responded positively, the Columbia Ministry of trade and Industry issued Resolution No. 0235 to end the investigation into the import of aluminum profiles in China, and impose no final anti-dumping duty on China's aluminum profiles.

In the same year, Columbia implemented anti-dumping measures against aluminum products, and the Ministry of trade and industry formally put the case on record.

With the help of governments at all levels, the case has finally come to a successful conclusion.
In July this year, the Executive Committee of the Brazil Foreign Trade Commission issued Resolution No. forty-second in 2012, which made an anti circumvention final on imports of shoes from China, and decided to impose 182% anti tax avoidance on Chinese outsoles and soles.
According to the Ministry of industry and trade of Brazil, China's footwear exports account for more than 60% of the raw materials used by the footwear industry in Brazil, and the added value of industrial production is less than 25%.
In addition to min FA aluminum, Quanzhou Zhongzhi company also successfully responded to US anti-dumping.
Since 2005, the company has been actively responding to anti-dumping through the "litigation Association", so as to win a lower tax rate for enterprises.
The latest is the beginning of the year, the US Department of Commerce made a preliminary decision, giving the enterprise 8.5% of the average tax rate, other non respondent enterprises tax rate as high as 164.09%, the end of this year, the United States Department of Commerce will respond to the case for an annual review final.
Four body joint active defense
Because of the long time and high cost of the international anti-dumping cases, and the Chinese enterprises often lose more than one after the lawsuit, many enterprises often have negative attitude when they encounter anti-dumping cases.
But facts have proved that if enterprises respond positively, they will not only retain the original market, but also occupy the share of other non respondent enterprises.
For example, Quanzhou Zhongzhi company exports to the US last year increased 73 times than in 2004.
Relevant experts believe that the "four body linkage" working mechanism is an effective guarantee for responding. That is, in conjunction with the Ministry of Commerce, the provincial foreign trade and Economic Cooperation Department, the Quanzhou Municipal Bureau of foreign trade and economic cooperation, and the strength of trade associations, experts and lawyers are required to implement "one to one" door-to-door counselling, and to negotiate with the local embassies through the state departments to coordinate with the embassies abroad.
In addition, the relevant industry associations play a window role in publicizing different enterprises, so that enterprises can understand the importance of active prosecution.
In addition, experts believe that the following four points are the key points for successful prosecution.
First of all, when confronted with anti-dumping cases, enterprises must set up a special response team; secondly, hire local professional lawyers to participate, and local professional lawyers can effectively provide all kinds of assistance that is in line with the local conditions, including the most accurate market situation of the local people and the local market; the other is to try to convince foreign importers to participate in the response; finally, the respondent enterprises must improve the management system of the company, and once the lack of information, it may lead to a losing lawsuit directly.
