Law enforcement officers immediately launched an investigation into the two units.

It is found that the first production unit of infringing children's clothing has an area of about 400 square meters, and the production workshop is an integral whole. There are 12 sewing machines and 12 production workers in the field inspection. In general, it seems to be a typical small-scale children's clothing processing enterprise.

In the warehouse, law enforcement officers found that all kinds of children's clothing packed in bundles, ranging from 10 to 20 bundles, were stacked by category. Among them, dozens of bundles were suspected of infringement of children's clothing by Disney trademark.

Law enforcement officers carefully inspected their children's clothing style, suspected of infringing children's wear has two categories of short sleeved children's wear and long sleeved children's clothing, each of which has white, gray, yellow, red and other different colors, the front printed with "MICKEY", "MICKEY MOUSE" and other words and similar to Mickey Mouse and its head silhouette and other patterns.

The second production units are very similar to the first place in their operation and production. There are more than a dozen sewing machines and 9 operators at the scene. In the warehouse, children's clothes printed with the words "DISNEY", "DISNEY GET" and Mickey Mouse or Donald Duck are silhouetted or silhouetted.

The law enforcement officers collate the alleged infringement of children's clothing in two units. After counting, there are altogether 1876 pieces.

Spot infringement of suspected infringement

They have used the relevant patterns from the market and the Internet to their children's clothing without authorization. China's trademark law stipulates that trademark registrants enjoy the right to exclusive use of trademarks and are protected by law. Foreigners or foreign enterprises applying for trademark registration and handling other trademark matters in China shall entrust a trademark agency established according to law.

In this case, "MICKEY MOUSE" and Mickey Mouse pattern are all registered trademarks of Disney company, and the approved range of use includes clothing and other commodities.

The above children's clothing has been recognized by Disney Enterprises Inc's domestic agency as "non Disney authorized production and sale of products".

This year coincides with the opening of Disney theme park in Shanghai. "Disney" souvenirs and derivatives are bound to lead a new trend in the fields of production, commodity circulation, trademark printing, advertising and network sales.

SAIC also issued a notice in November 2015 to launch a special action to protect the "Disney" registered trademark nationwide, requiring all industrial and commercial regulatory authorities to crack down on violations.

Illegal acts of exclusive right to use registered trademarks promote fair competition in the market environment, safeguard consumers' legitimate rights and interests and protect China's international image of intellectual property rights.

At present, law enforcement officers have adopted administrative coercive measures to seize all children's clothing products that are involved in trademark infringement according to law, and make further investigation and handling of the two illegal acts.
