Fraudulent Contract Fraud

Fraud: using contract to defraud is one of the most common tricks.

Case: Guiyang police revealed that there have been several new contract frauds in recent years in the city, which are very similar in ways of committing crimes. They defrauded merchants' trust by ordering large quantities or selling at low prices, and then fled for small kickbacks or advance payments.

According to the investigators, in June this year, a security company in Jiamusi, Heilongjiang, received a telephone call from a staff member of a Guiyang material company, calling it a shipment of 12 million yuan worth of jewellery to escort the security company from Jiamusi to Guiyang. The escort cost was 600 thousand yuan, but deducted 40 thousand yuan from the rebate.

In July 7th, security company salesman Gao went to Guiyang from Jiamusi and signed an escort agreement with Jiangmou, general manager of Guiyang material company. After signing the agreement, the two companies went through the advance payment pfer procedures to the bank, and agreed that the Jiamusi security company paid a 40 thousand yuan rebate to a Guiyang material company.

After that, the security company had never seen the other person coming to the bank, so they went to the bank to check and found that the advance payment of 300 thousand yuan did not arrive. When they contacted the Guiyang material company, they could not find anyone, and they were deceived.

Case: a few days ago, Hong Yueying, a defendant in the crime of fraud, who took advantage of the purchase and sale contract to take the high and low price out of the goods and destroy the market economy order, was sentenced to 14 years' imprisonment in the first instance by the people's Court of Fuding, Fujian, and a fine of 200 thousand yuan, deprived of political rights for 3 years.

In November of 1998, defendant Hong Yueying and others signed the purchase and sale contract with Tianhe company for 2 sets of Xiamen Z50 loader (316 thousand yuan per unit) and 1 Daewoo excavators in Zhejiang (770 thousand yuan) in the name of the Sales Department of Pingyang electrical and mechanical equipment company.

After obtaining 3 Mechanical cars, the defendant paid only 110 thousand yuan to Tianhe company, and then sold them to 250 thousand yuan, 270 thousand yuan and 480 thousand yuan per unit, respectively, and received 940 thousand yuan (another 60 thousand yuan was not recovered).

The defendant paid only 380 thousand yuan to the Tianhe company's loan, and absconded with the balance, which still owed 912 thousand yuan to Tianhe company.

Defendant Hong Yueying also paid part of the money in April 2001 with others to cheat the Fuzhou Meifeng plywood factory for 24 thousand yuan and 19 thousand and 50 yuan for the Jianou County Housing Road farm.
