Clothing Property Rights: A Game Of Winning The Future
Analyzing the current situation of the concentration of intellectual property disputes in the exhibition, the experts pointed out that the core competitiveness of textile and garment enterprises generally comes from product innovation, flower design and brand influence. Compared with many industries such as pharmaceuticals, electronics, etc., the content of science and technology is not high. Therefore, piracy and infringement become the "best choice" for small and medium-sized enterprises with weak comprehensive strength when the cost of infringement is less than the cost of safeguarding rights.
At present, China's position as a major textile producer under the background of economic globalization, and the increasingly strong international influence of China's international textile machinery exhibition, home textile exhibition, clothing exhibition and fabric exhibition, has attracted more and more attention from the world, making the exhibition site an important place for Chinese and foreign businessmen to pay close attention to peer products and information collection, so the contradictions of intellectual property rights are also concentrated here.
For example, China International Textile Machinery Exhibition (CITME), as one of the four largest international textile machinery exhibitions in the world, is attracting more and more attention from textile manufacturers and professional buyers, especially foreign exhibitors.
Take the 2006 International Textile Machinery Exhibition, which ended in October, during the exhibition, the Intellectual Property Office of the exhibition received 7 complaints, involving 10 patents and 18 exhibitors. Among them, 5 overseas exhibitors complained, involving 8 patents and 8 exhibitors.
All kinds of intellectual property problems are gathered in front of the organizers of the exhibition, while the sponsors can only mediate because they do not have the right to enforce the law, which increases the difficulty of solving intellectual property disputes quickly and effectively.
To this end, the China Textile Association of the International Trade Promotion Commission began its exploration and efforts in the related work since the mid 90s of last century.
Through the practice in recent years, intellectual property protection has entered the track on several famous international professional exhibitions sponsored by them.
The person concerned told reporters: "in order to effectively ensure the intellectual property rights dispute has been satisfactorily resolved, the organizer of the exhibition usually enters into the contract with the exhibitors to make relevant provisions first, to standardize the rights and obligations of exhibitors in terms of intellectual property rights in the form of contracts, to fully carry out the functions of the trade associations, to communicate, guide and mediate, to strengthen cooperation with relevant administrative and legal organs, to invite law enforcement personnel and legal experts to enter the exhibition intellectual property consultation office, and to ensure the authority, professionalism and high efficiency of the intellectual property protection work of the exhibition."
As a result, the handling capacity of the exhibition on intellectual property disputes has been greatly improved.
Contradictions exist in exhibitions, but problems come from reality.
Comparatively speaking, under the circumstances of foreign businessmen's absolute right to speak with intellectual property weapons, the general situation of China's textile and garment enterprises is that enterprises do not understand the basic knowledge related to intellectual property rights, and the consciousness of self protection by using intellectual property rights is often weak.
For this reason, Huang Xiaoliang, who has paid close attention to intellectual property disputes in recent years, is deeply touched.
For example, he said that during a certain international textile exhibition, a large scale home textile enterprise with strong design ability in Zhejiang was accused of infringement.
After investigation, the exhibition Intellectual Property Office found that the original complaint company not only produced its own design products, but also processed products according to the patterns provided by customers.
As we all know, the design patterns provided by the clients infringe the copyright of others.
According to the law, the production of products with infringing patterns also constitutes infringement.
Therefore, he pointed out in particular that "during the exhibition, we combine the mediation and consultation of intellectual property rights, not only to stop the occurrence of intellectual property rights violations, but also to safeguard the legitimate interests of exhibitors, and publicize and educate enterprises in terms of intellectual property rights, so as to fundamentally eliminate intellectual property violations."

Then, is it true that only big enterprises are qualified to do something in the field of intellectual property?
The answer is negative: "enterprises are not afraid of small businesses, but they are afraid of not being standardized.
There are many small and medium enterprises in Italy and France, and finally they have made big brands.
Some experts point out that when the relevant state laws and regulations are further improved and the enforcement of intellectual property protection is strengthened, when enterprises themselves are "pursuing" in brand building and product innovation, they will have a need for intellectual property protection and consciously become the maintainers of intellectual property rights.
At present, the leading industry in the industry is not only in product innovation, operation and sales, but also in the aspect of social responsibility, corporate culture and intellectual property protection.
Standing on the threshold of joining the WTO 5th anniversary, looking forward to the next five years, the construction of important projects such as brand building and scientific and technological progress depends on the progress and improvement of intellectual property protection.
For those Chinese textile and garment enterprises that have stood the test of the global economic game for five years, the next five years are worth looking forward to.
