Ministry Of Industry Issued A New Internet Regulation: Software Installation And Evaluation Into Management

The Ministry of industry and information technology has promulgated the specification recently.

Li Guobin, inspector of the Ministry of political science and law of the Ministry of industry and commerce, said in December 31st that this regulation regulated the activities of Internet information services and related to Internet information services.

In recent years, China's Internet has developed rapidly, and new technologies and applications have emerged one after another. It has become an important part of production and life.

At present, the number of Internet users in China has reached 497 million, and Internet information providers have reached 355.

At the same time, the competition of Internet information service is increasingly fierce, and the number of illegal activities is increasing.

This regulation is intended to regulate the order of the Internet information service market, and explicitly prohibit the infringement of other Internet information service providers' rights and interests, including malicious interference with other Internet information service providers on the user terminals, or downloading, installing, running and upgrading products, fabricating and disseminating false facts to damage the legitimate rights of other Internet information providers.

In addition, the regulations specify eight acts that Internet information service providers may not implement, including refusing or delaying the provision of services or products to users without justifiable reasons; restricting users to use their designated services or products.

The new regulations explicitly require that software downloading, installation, operation, upgrading, unloading and other operations on the user terminal should be obtained in advance with the consent of the user and provide a complete and complete software function, so as to prohibit deceiving, misleading or forcing users to install and run software.

For the pop-up behavior of advertising windows, Internet information service providers should provide users with functional signs to close or exit windows in a significant way.

The new regulation has strengthened the protection of users' personal information.

On the basis of defining "user personal information" as "information related to users and being able to identify information of users separately or with other information", the new regulation provides for the user's personal information collection and usage behavior in principle, requiring that Internet information service providers should properly keep personal information of users and not to provide them to others without authorization. If the user's personal information is leaked or may be leaked, users should immediately take remedial measures; if they cause or may cause serious consequences, they should immediately report to the telecommunication management organization and cooperate with the investigation and handling.

Li Guobin said that the related illegal activities in recent years highlighted the lack of laws and regulations related to Internet information services and the lack of specific behavioral norms.

This provision further clarified the rules and behavior boundaries of Internet information services, which is conducive to settling disputes and establishing a service environment for lawful operation and safeguarding rights according to law, and protecting the legitimate rights and interests of Internet information providers and users.
