In response to this, the reporter interviewed Zhang Gengyuan, lawyer of Tongfang law firm in Liaoning. Zhang believes that the shopping ticket is equivalent to a contract. The content of the contract is nothing but a retreat, and the other is not to give up.
There are mainly two Executive Standards for shopping tickets: one is elimination, and the other is contract law.
According to the legislative basis of consumer law is to protect consumers, the contract should be interpreted in favor of consumers.
From the contract law, the contract law is used to adjust the law between the equal subjects. However, the latest judicial interpretation made by the contract law just this year stipulates that if there is a standard clause in the contract which is "not clear enough", then it is necessary to do an explanation for the setting up of the standard terms. It is also agreed that the contract can be "back" and "non refundable".
Zhang lawyers said that such disputes consumers can go to the consumer association to complain. If the coordination fails, consumers can sue the court by way of legal proceedings, by retaining the shopping vouchers or small bills with standard clauses and other relevant evidence.
The reporter consulted several people in charge of luxury stores in Shenyang. According to the insiders, many luxury goods sold in Shenyang did not have the "unconditional return" service. Maybe this is related to luxury brands in China, so the shopping malls also expressed frustration.
