    From December 1998 to Yao's company, Mr. Zhou did not sign a labor contract.

    In October 2007, the new labor law promulgated, the labor and social security bureau concerned to the company to give lectures to employees, teaching staff how to protect their legitimate rights and interests, and the necessity of signing labor contracts.

    In November 2007, when the company asked Mr. Zhou to sign a contract with the unit, Mr. Zhou suddenly joined the other 12 workers and asked the company to renew the overtime wages of 110 statutory holidays and 1040 rest days.

    The company refused to pay.

    In April 15th of this year, Mr. Zhou and his 12 colleagues joined the company on the Nan'an District arbitration committee, and was rejected by the Arbitration Commission.

    The workers refused to accept the direct report of the company to the Nan'an District Court.

    It is understood that among the 13 workers, the company required the company to pay overtime for up to about 200000 yuan, and at least 70 thousand yuan.

    Today, the Nan'an District Court will hear the case.

    Lawyer: the "irregular working system" does not work overtime on weekends. Liao Cuijuan thinks that Mr. Zhou and his company are piecework wages.

    That is to say, how many pairs of shoes are processed, the wages will be calculated according to the number of shoes.

    This is called "irregular working system" in law.

    Liao explained that the unit with "irregular working hours" could not work overtime if it had to work overtime on weekends.

    Only in the face of national day, may day and other statutory holidays, can we calculate wages according to overtime work.
