Internet Information Search Service Management Regulations Issued In June 25Th

The state Internet Information Office issued the "Internet information search service management regulations" in June 25th (hereinafter referred to as the "Regulations").

"It aims at standardizing Internet information search service, promoting the healthy and orderly development of Internet information search industry, protecting the legitimate rights and interests of citizens, legal persons and other organizations, and safeguarding national security and public interests.

According to the regulations, the state Internet information office is responsible for the supervision and administration of the Internet information search service in the whole country. The local Internet information office is responsible for the supervision and administration of the Internet information search service in the administrative area.

According to the regulations, Internet information search service providers should implement the main responsibility, establish and improve the information security management system such as information audit and public information real-time inspection, etc., and shall not provide information contained in laws and regulations in the form of links, abstracts, associative words, etc.; providing paid search information services shall check the qualification of customers according to law, clearly specify the upper limit of paid search information pages, distinguish between natural search results and paid search information, deal with fees and search information one by one, mark prominently, and do not get illegitimate interests by breaking related links.

The head of the state Internet Information Office has said that search engines play an important role in integrating information on the Internet and user access, but there are many problems at the same time.

Some search results contain illegal information such as rumors, obscenity, pornography, violence, homicide, horror and so on. Some of the search results are objective and fair, violate the industry ethics and norms, and mislead and influence public judgment.

These problems have damaged the network ecology, disrupted the order of Internet information dissemination, infringed upon the public interest, and the netizens abhorred.

The head of the state Internet Information Office stressed that Internet information search service providers should take effective corporate social responsibility, strengthen their own management according to relevant laws and regulations, and provide objective, fair and authoritative search results for netizens.

At the same time, enterprises should improve the professionalism of Internet information search service practitioners, establish and improve the system of complaints, reporting, handling and protecting users' rights and interests, and take the initiative to accept public supervision.

Article 1. In order to standardize Internet information search service, promote the healthy and orderly development of Internet information search industry, protect the legitimate rights and interests of citizens, legal persons and other organizations, and safeguard national security and public interests.

"The decision of the Standing Committee of the Standing Committee of the people's Congress on strengthening the protection of network information" and "the State Council's notice on Authorizing the state Internet information office to take charge of Internet information content management" is formulated.

The second article applies to the Internet information search service in People's Republic of China.

The term "Internet information search service" as mentioned in these Provisions refers to the collection and processing of all kinds of information from the Internet for users to retrieve services by using computer technology.

The third national Internet information office is responsible for the supervision and administration of the nationwide Internet information search service.

The local Internet information office is responsible for the supervision and administration of the Internet information search service in its administrative area.

The fourth Internet information search service industry organization should establish and improve the industry self-discipline system and industry standards, guide Internet information search service providers to establish and improve service standards, and urge Internet information search providers to provide services according to law and accept social supervision, so as to improve the professional literacy of Internet information search service practitioners.

The fifth Internet information search service providers shall obtain relevant qualifications stipulated by laws and regulations.

The sixth Internet information search service providers should implement the main responsibility, establish and improve the information security management system, such as information audit, public information real-time inspection, emergency disposal and personal information protection, with safe and controllable preventive measures, and provide necessary technical support for the departments concerned to perform their duties according to law.

The seventh Internet information search service providers shall not provide information content prohibited by laws and regulations in the form of links, abstracts, snapshots, associative words, related searches, and related recommendations.

The eighth Internet information search service provider found that the search results clearly contained information, websites and applications prohibited by laws and regulations. It should stop providing relevant search results, keep relevant records, and report to the state or local Internet Information Office in a timely manner.

The ninth Internet information search service providers and their employees shall not seek illegitimate interests by breaking related links or providing search results containing false information.

The tenth Internet information search service providers shall provide objective, fair and authoritative search results, and shall not damage the interests of the state, the public, and the legitimate rights and interests of citizens, legal persons and other organizations.

The eleventh Internet information search service providers provide paid search information services. They should check the qualification of customers according to law, make sure that the proportion of paid search information pages is the upper limit, distinguish between natural search results and paid search information, and pay attention to fees and search information by adding marked markup one by one.

Internet information search service providers should comply with relevant laws and regulations to provide commercial advertising information services.

The twelfth Internet information search service providers should establish and improve the system of public complaints, reporting and protection of users' rights and interests, publish complaints and reporting methods in a prominent position, take the initiative to accept public supervision, deal with public complaints and reports in time, and assume liability for damages to users' rights and interests in accordance with the law.

The thirteenth Provisions come into effect on August 1, 2016.
