Regulations on port planning and Administration (Ministry of communications Order No. eleventh 2007)

The regulations on port planning administration have been approved by the twelfth ministerial meeting on 30 November 2007 and are hereby promulgated and implemented from February 1, 2008.

Port planning management regulations

general provisions

Article 1. These Provisions are formulated in accordance with the Port Law of the People's Republic of China in order to standardize port planning work, scientifically utilize and effectively protect port resources, and promote healthy and sustainable development of ports.

The second provision applies to activities such as compilation, examination and approval, publication, revision and adjustment, implementation, supervision and management of port planning.

The third Ministry of communications is responsible for the port planning and management of the whole country.

The port administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government are responsible for the port planning and management within their respective administrative areas.

The ports where the ports are located (the cities in the districts, the same below), the counties (including the county-level cities), the port administrative departments of the people's governments, or the departments responsible for the specific port management established by the people's governments of the provinces and autonomous regions shall specifically implement the planning and management of the port.

The port administrative departments as mentioned in these Provisions include the traffic administrative departments that bear the functions of port administration, or the port administrative departments established by the competent traffic departments.

The fourth port planning should be formulated in accordance with the requirements of national economic and social development and the needs of national defense construction, taking into consideration factors such as industrial layout, port resource conditions and comprehensive pport network conditions, so as to embody the principle of implementing Scientific Outlook on Development and making rational use of coastline resources.

The fifth port planning should conform to the planning of urban system, and shall be linked up with and coordinated with other general plans of land use, urban master plan, river basin planning, flood control planning, marine functional zoning, water pport development planning and other pportation modes, as well as other relevant plans regulated by laws and administrative regulations.

The second chapter is the compilation of port planning.

The sixth port planning includes port layout planning and port master plan.

Port layout planning refers to the distribution planning of ports.

Port layout planning includes port layout planning and port layout planning of provinces, autonomous regions and municipalities directly under the central government.

For areas with abundant port resources and densely distributed ports, port layout plans across provinces, autonomous regions, municipalities directly under the central government or provinces and autonomous regions can be compiled according to needs.

Port master plan refers to the specific planning of a port in a certain period.

The seventh port layout planning mainly determines the overall development direction of the port, defines the status, function, main functions and layout of each port, and rationally plans the port shoreline resources, promotes the healthy, orderly and coordinated development of the ports in the region, and guides the compilation of the general layout of the ports in the region.

The port master plan mainly determines the port's nature, function and port area division. Based on port resource conditions, throughput forecast and port type analysis, the planning of port shoreline utilization, land and waterfront layout, port boundary and port construction land allocation is emphasized.

The eighth municipalities directly under the central government can not formulate port layout plan according to the actual situation, and only prepare the port master plan.

Ninth, when preparing and revising and adjusting port layout planning and port master plan, relevant special plans should be formulated according to needs.

The special planning of port layout planning includes hierarchical port layout planning, port layout planning, port resource integration planning and other special planning.

The special planning of port master plan includes overall planning of port area, planning of port collection and distribution facilities and port Park, bonded, logistics and other special park planning and other special plans.

Special planning is an integral part of port layout planning and port master plan.

The tenth organization that organizes the port master plan shall organize the detailed control plan for the port area and the operation area according to the approved port master plan.

Control detailed planning for port area and operation area refers to the deepening plan for port area planning in port master plan.

The eleventh national port layout plan is compiled by the Ministry of communications, and the port layout planning of provinces, autonomous regions and municipalities directly under the central government shall be jointly formulated by the Ministry of communications by the port administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government.

The port layout planning of provinces, autonomous regions and municipalities directly under the central government shall be formulated by the port administrative departments of the people's governments of provinces, autonomous regions and municipalities directly under the central government; the port layout planning for the p provincial cities in the provinces and autonomous regions shall be jointly formulated by the port administrative departments of the people's governments of provinces and autonomous regions and the port administrative departments of the Municipal People's governments.

The general plan for the twelfth major ports shall be formulated by the departments in charge of the port administration under the port administration department of the port, the Municipal People's government, or the people's Government of the province or autonomous region.

The master plan for ports other than major ports shall be compiled by the port administrative department of the municipal or county people's Government of the port.

The thirteenth port planning should meet the following requirements:

(1) effective protection and economical use of port resources to achieve sustainable development of the port;

(two) to meet the requirements of the country's opening to the outside world and the coordinated development of the regional economy and the rational distribution of the industry in the eastern and western regions;

(three) promoting the coordinated development of modern integrated pport system and giving full play to the role of ports as a comprehensive pport hub for various modes of pport.

(four) coordinating the rational layout and functional division of ports at different levels, optimizing port resource allocation and enhancing the overall competitiveness of port groups;

(five) depending on the progress of science and technology and adapting to the requirements of the development of international and domestic shipping and modern logistics, we will improve the specialization, scale, intensification and modernization of ports.

The port layout planning of fourteenth provinces, autonomous regions and municipalities directly under the central government and the port layout plan of provinces, autonomous regions and municipalities directly under the central government should conform to the port layout plan of the whole country.

The port layout plan in the provinces and autonomous regions should conform to the port layout plan of provinces and autonomous regions.

The port master plan should conform to the corresponding port layout plan.

Fifteenth, when making and revising the port layout plan and port master plan, the development of the Xingang area or the adjustment of the functions of the existing port area should be carried out.

The overall planning of the port area should be worked out after the completion of the port master plan.

The compilation of the control detailed plans for the sixteenth port areas and operation areas should optimize the overall layout of the water and land areas of the port area, and make overall arrangements for the layout of the supporting facilities in the port area, such as collection and distribution, water supply and drainage, power supply, communication information, safety supervision, port management, environmental protection, etc., and coordinate and link up with the relevant facilities of the urban planning.

When preparing the port planning, the seventeenth departments of the port planning department should seek advice from the relevant departments of the same level development and reform, urban planning, land, railways, water conservancy, marine and other relevant military departments, as well as maritime and waterway management institutions.

Where the port management department and the traffic control department are separately established, they should also seek advice from the traffic authorities at the same level.

The eighteenth port planning shall be compiled in accordance with the requirements for the formulation of the port planning and the format of the text in accordance with the unified port planning formulated by the Ministry of communications.

Nineteenth, the preparation of port planning shall be carried out in accordance with the law in accordance with the law, and comply with the procedures, contents and depth requirements of the environmental impact assessment stipulated by the state.

The twentieth port planning should conform to the relevant specifications and technical requirements of port engineering, and consider the relationship between navigation and navigation safety and port layout.

The specific compilation work of the twenty-first port planning shall be entrusted to the units with corresponding qualifications prescribed by the state.

The general layout of the port layout plan, major ports and important regional ports (including the corresponding special plans and the detailed control plans for port areas and operation areas) shall be entrusted to the establishment of the first class engineering consultation qualification certificate or the class a engineering design certificate of the port and waterway engineering profession; the general planning of other ports shall be entrusted to the establishment of the unit that holds the qualification certificate of engineering qualification of grade B or above of the port and river engineering specialty or the engineering design certificate of the water pport industry grade B or above.

The regional important ports referred to in the preceding paragraph refer to the important ports in the region determined by the people's governments of provinces, autonomous regions and municipalities directly under the central government in accordance with the provisions of the port law.

The third chapter is the approval and announcement of port planning.

The twenty-second national port layout plan is promulgated and implemented by the Ministry of communications after being submitted to the State Council for approval.

The port layout plan of the twenty-third provinces, autonomous regions and municipalities directly under the central government shall be approved and promulgated by the Ministry of communications after the relevant people's governments of provinces, autonomous regions and municipalities directly under the central government and relevant departments of the State Council have been approved.

The port layout plan of the twenty-fourth provinces, autonomous regions and municipalities directly under the central government and the port layout plan for the p provincial cities in the provinces and autonomous regions shall be examined and approved by the port administrative departments of the provinces, autonomous regions and municipalities directly under the central government, and the people's governments of the autonomous regions and municipalities directly under the central government shall seek the opinions of the Ministry of communications in writing.

The Ministry of Communications shall submit opinions within 30 working days from the date of receipt of the materials for soliciting opinions.

If the opinions agreed or put forward by the Ministry of communications are adopted or the opinions are not raised within the time limit mentioned above, the relevant people's governments of provinces, autonomous regions and municipalities directly under the central government may promulgate them according to law.

The people's governments of provinces, autonomous regions and municipalities directly under the central government have objections to the amendments proposed by the Ministry of communications, and shall be submitted to the State Council for decision.

The twenty-fifth main port cities are municipalities directly under the central government, and the port master plan is submitted to the Ministry of communications and the people's Government of the municipality directly under the central government for examination and approval.

The main port is not a municipality directly under the central government. Its port master plan is reported by the port administrative department of the port where the city is located, and the Municipal People's Government shall examine it. The Municipal People's Government shall report it to the Ministry of communications and the people's Government of the province or autonomous region for examination and approval.

The scope of port master plan involves cross administrative regions for special reasons. The relevant people's governments should coordinate the planning contents before the port master plan is submitted.

The Ministry of communications, together with the people's governments of provinces, autonomous regions and municipalities directly under the central government, shall examine the general plans for the port to be reported, and shall consult the relevant departments of the State Council and the relevant military organs in the process of examination.

The people's Government of the Ministry of communications and the people's Government of provinces, autonomous regions and municipalities directly under the central government shall promulgate the approval after examination.

The general plan of the twenty-sixth regional important ports shall be examined and approved by the municipal and county port administrative departments of the port where the municipal and County People's governments have examined and approved, and the municipal and County People's governments shall examine and approve the provincial and autonomous regional people's governments.

The people's governments of provinces and autonomous regions shall examine the general plans for the reporting of important regional ports, and shall, in the process of examination, seek the opinions of the Ministry of communications in writing.

Upon examination and approval, the people's Government of the province or autonomous region shall promulgate it.

The port administrative department shall report to the Ministry of Communications the general plan for the promulgation and implementation of the regional important ports.

The general plan for ports other than twenty-seventh major ports and regional important ports shall be submitted to the municipal and County People's governments for examination and approval by the port administrative departments of cities and counties where the ports are located.

The people's Government of the city or county shall examine the general plan for the port to be reported, and shall, in the process of examination, seek the opinions of the port administrative department of the people's Government of the province or autonomous region in writing.
