Shipping Inspection Regulations For Shipping Export Commodities

Article 1 in order to ensure the proper loading conditions and the quality of export commodities for shipping and export commodities, and to safeguard the legitimate rights and interests of all parties involved in foreign trade, the present Measures are formulated in accordance with the provisions of the law of the People's Republic of China on import and export commodity inspection (hereinafter referred to as the commodity inspection law) and its implementing regulations.

The second national import and Export Commodity Inspection Bureau (hereinafter referred to as the State Commodity Inspection Bureau) is in charge of the inspection of the cargo carrying cargo exported to the whole country. According to the needs of the development of foreign trade, the perishable food and frozen products that are exported and exported by the ship cabin are formulated, adjusted and promulgated.

The import and Export Commodity Inspection Bureau of the State Commodity Inspection Bureau located in the provinces, autonomous regions, municipalities directly under the central government, and the ports and distributing centers of the import and export commodities, hereinafter referred to as commodity inspection authorities, shall carry out statutory inspection of the cargo cabins within the scope of export commodities that are subject to statutory inspection.

The third commodity inspection authorities shall carry out inspection of the cargo hold of the statutory inspection of cargo at the port of shipment, in accordance with the standards laid down by the State Commodity Inspection Bureau; if there are special provisions in foreign trade, pportation or insurance contracts and documents, the inspection shall be conducted according to the relevant provisions.

The fourth is that the ship's cabin should be subject to the statutory inspection of cargo. The carrier or his agent must apply to the local commodity inspection authority before the loading to apply for the inspection of the whole ship's loading, such as ship cleaning, sealing and refrigeration, and provide the loading list, stowage plan and other related documents.

The above cabin must be checked by the commodity inspection authority, which meets the technical requirements of shipment and has obtained the certificate of conformity.

The fifth carrier shall inspect the cargo hold before the inspection of the cargo hold by the commodity inspection authority, and timely report to the commodity inspection authorities in accordance with the characteristics and requirements of the goods to be installed.

After accepting the application, the sixth commodity inspection authorities shall send the crew to the inspection module in time to issue a qualified certificate for the inspection of the qualified cabin. If the inspection is not in conformity with the technical conditions of the shipment, the carrier shall clear the goods in time and check by the commodity inspection authority.

The re examination is limited to one time. The ship's cabin which is still unqualified and needs to be tested is reviewed. The carrier or his agent should arrange the shipping technical conditions of the cabin and re apply the inspection to the commodity inspection authorities.

The seventh is the inspection of other inspection bodies authorized by the commodity inspection authorities or the State Commodity Inspection Bureau. The inspection should be carried out in the no-load cabin of the statutory cargo inspection port. The carrier or his agent shall apply to the local commodity inspection authority for inspection.

If the inspection is qualified, the port cargo inspection organization shall be affixed to the original certificate of inspection certificate before the shipment is made.

If the cargo inspection organization finds that the cabin is not in conformity with the technical conditions for shipment, the carrier must clear the cabin and re apply the inspection to the cargo inspection authority at the port of loading.

After the inspection is qualified, the inspection authority of the port of loading will re issue the qualification certificate for the inspection, so that the shipment will be carried out.

The eighth one is to carry out the inspection of the cargo cabins other than the export commodities scope of the statutory inspection cabin, the commodity inspection authorities or the designated inspection organizations, or by the entrustment of foreign trade organizations or foreign inspection organizations.

Ninth commodity inspection authorities inspect the cabin and collect the inspection fee according to the regulations.

The sixth and seventh stipulations of the present measures require that the new commodity inspection organization be required to re collect the inspection fee according to the regulations.

The inspectors of the commodity inspection authorities shall provide necessary working conditions and auxiliary manpower when inspecting and supervising the cabin of the ship according to law.

In the event that tenth carriers or their agents violate the provisions of the fourth, second and seventh provisions of the present measures, the commodity inspection authorities shall be punished according to the relevant provisions of the commodity inspection law and their implementing regulations.

The eleventh way is to be explained by the State Commodity Inspection Bureau.

The twelfth measures shall come into force on March 1, 1995, and the inspection methods for exported grain, oil, food and refrigerated cargo compartments issued by the State Commodity Inspection Bureau in July 1, 1984 shall be abolished simultaneously.
