    Regulations On Trade Union Work In Enterprises

    general provisions



    Article 1 in order to strengthen and improve the work of trade unions in enterprises and give play to the role of trade unions in enterprises, these Regulations are formulated in accordance with the trade union law, the labor law and the articles of association of Chinese trade unions.



    The second trade unions are the grass-roots organizations of the all China Federation of trade unions, the important organizational foundation and working basis of trade unions, and the representatives and defenders of the legitimate rights and interests of trade union members and workers.



    The third trade unions, guided by the Deng Xiaoping theory and the important thought of "Three Represents", implement the Scientific Outlook on Development, adhere to the fundamental guiding principle of relying on the working class wholeheartedly, follow the path of developing socialist trade unions with Chinese characteristics, implement the working principle of "organizing and safeguarding rights", and unite and mobilize workers to contribute to the grand goal of building a well-off society in an all-round way.



    The fourth is to implement the working principles of promoting the development of enterprises and safeguarding the rights and interests of workers, coordinating the labor relations between enterprises and promoting the construction of harmonious enterprises.



    The fifth trade unions, under the leadership of the party organizations and higher level trade unions of the enterprises, work independently and independently according to laws and Trade Union regulations. They are closely related to the masses of workers and staff members, are concerned about the production and life of the workers and workers, and serve the staff and workers with enthusiasm.



    The second chapter is the enterprise union organization.



    The sixth trade unions shall organize workers to join trade unions in accordance with the law and safeguard the rights of workers to join trade unions.



    Seventh enterprises with more than twenty-five members shall establish a trade union committee; less than twenty-five persons may establish a trade union committee alone, or a member of two or more enterprises should establish a grass-roots trade union committee by region or industry.

    At the same time, in accordance with the relevant provisions, the establishment of Trade Union funding Committee and trade union women's staff committee.



    If an enterprise trade union has the conditions of a legal person, it shall obtain the legal person qualification of a social organization according to law, and the president of a trade union shall be a legal representative.

    The trade unions of enterprises shall be protected by law, and no organization or individual shall be allowed to revoke or trade union organizations to other departments at will.



    Enterprise restructuring must establish and improve trade union organizations at the same time.



    The eighth general assembly or member congress is the organ of power of the trade union of the enterprise. It holds one to two meetings each year.

    A temporary meeting may be held by the trade union committee or more than 1/3 of the members.



    The representatives of members' congresses are democratically elected by members, and permanent members are appointed. The term of office is the same as that of the current trade union committee of the enterprises.



    A trade union member with a membership below one hundred shall convene a general meeting.



    The functions of the ninth general assembly or members' Congress:



    (1) to deliberate and approve the work report of the trade union committee.


    (two) to consider and approve the report on the expenditures and expenditures of the trade union committee and the work report of the funding Review Committee.


    (three) election of the trade union committee and the Finance Review Committee.


    (four) listen to the report of the chairmen and vice chairmen of the trade union and conduct democratic appraisal.


    (five) to replace or remove the representatives elected by them or the members of the trade union committee.


    (six) discuss and decide other important issues of trade union work.



    The tenth general assembly or member congress shall be exercised separately from the staff congress or workers' Congress, and shall not be substituted for each other.



    The eleventh trade union committee shall be elected by the difference between the general meeting of the members or the general assembly of the members. The result of the election shall be submitted to the higher level trade union for approval for a term of three years or five years.



    The trade union of a large enterprise can establish a standing committee to be responsible for the daily work of the trade union committee, with the approval of the higher level trade union, and its subordinate units may establish a trade union committee.



    The twelfth trade union committee is a permanent establishment of a general assembly or a member's Congress. It is responsible for the general assembly or the general assembly of members, and is subject to the supervision of members.

    Responsible for routine work during the session of the general assembly or the general assembly of members.



    The thirteenth trade union committee shall set up relevant working bodies or special working committees and working groups according to the needs of work.



    The full-time staff members of the trade union are generally provided by 3/1000 of the number of employees, and the specific number is determined by the higher level trade union, the enterprise union and the administrative consultation of the enterprise.



    In accordance with the requirements of work and funding, trade unions can employ trade union staff from the society to establish a full-time and part-time cadre team.



    Fourteenth, the enterprise trade union committee implements democratic centralism, and important issues need to be decided through collective discussion.



    The fifteenth trade union members (Standing Committee) usually convene a meeting every quarter to discuss or decide the following questions:



    (1) implementing the resolutions of the general assembly or the general assembly of the members and the decisions and work arrangements of the party organizations and the higher level trade unions.


    (two) submit a report on the work of the general assembly or a member's Congress and an important request and report to the party organization and the higher level trade union.


    (three) trade union work plan and summary.


    (four) put forward proposals for enterprises to deal with major issues concerning enterprise development and employee rights and interests.


    (five) the implementation of the budget for trade unions and major financial expenditures.


    (six) other issues discussed and decided by the trade union committee.



    The sixteenth production workshops and teams and groups of enterprises set up trade union branches and trade union groups. Members elect members of trade unions and leaders of trade unions, and organize trade union activities.



    The seventeenth is to establish a contingent of trade union activists and give full play to the role of trade union activists.



    The third chapter is about basic tasks and ways of activities.



    The basic task of the eighteenth trade unions is:



    (1) to implement resolutions of the general assembly or members' congresses and decisions of the higher level trade unions.


    (two) organize staff members to participate in the democratic management and democratic supervision of enterprises through the workers' Congress or workers' Congress and other forms according to law, and inspect and supervise the implementation of resolutions of workers' congresses or workers' congresses.


    (three) help and guide workers to sign labor contracts with enterprises.

    We should consult and sign collective contracts with enterprises on the basis of labor remuneration, working hours, labor quota, rest and vacation, labor safety and health, insurance benefits, etc., and supervise the performance of collective contracts.

    Mediation of labor disputes.


    (four) organize workers to carry out mass economic and technological innovation activities such as labor competition, rationalization proposals, technological innovation, technological tackling, technical cooperation, inventions and creations, post training and technical competitions.


    (five) organization, selection, commendation of labor models, responsible for the daily management of labor models.


    (six) carry out ideological and political education for staff and workers, and organize workers to learn cultural, scientific and professional knowledge so as to improve the quality of workers and staff members.

    We should do well in staff culture, education and sports, and develop healthy cultural and sports activities.


    (seven) to assist and urge enterprises to do well in work remuneration, labor safety and health, insurance and welfare, and supervise the implementation of relevant laws and regulations.

    Participate in investigation and handling of labor safety and health accidents.

    We should help enterprises to do well the collective welfare of workers and staff members, do well the relief work for needy workers, do practical work for the staff, do good things and solve difficult problems.


    (eight) safeguard the special interests of women workers.


    (nine) strengthening organization construction, improving democratic life and managing membership membership well.


    (ten) to collect, manage and make good use of trade union funds and manage trade union assets and trade union enterprises.



    The nineteenth is to persist in mass and democratization, and to implement public affairs.

    Any important matter involving the interests of the members of the general assembly must be discussed and decided by the general assembly or the member's Congress.



    Twentieth, in accordance with the wishes of members and workers, we should rely on members and workers and staff members to carry out various forms of trade union activities.



    Twenty-first, when a trade union convene a meeting or organize an employee's activity, it needs to occupy the production time. It should obtain the consent of the enterprise beforehand.

    Enterprise administration should actively support trade union activities.



    Non full time members of a trade union occupy the production or working hours to attend meetings or engage in trade union work. Wages are paid within the time prescribed by law, and other treatment is not affected.



    The twenty-second one is to carry out the activities of building a staff house, establish a member's appraisal and construction work system, enhance the cohesive force of the trade union and improve the work level of the trade union.



    Promote enterprises to care for employees, guide employees to love enterprises and create harmonious labor relations.



    Fourth chapter president of trade union



    Twenty-third trade unions with more than two hundred employees are equipped with full-time trade union chairmen in accordance with the law.

    If a person in charge of a party organization at the same level acts as the chairman of the trade union, he shall be provided with a full-time vice president of the trade union.



    Twenty-fourth candidates for Trade Union presidency of state owned, collective and its holding enterprises shall be nominated by the party organizations at the same level and the higher level trade unions on the basis of fully listening to the opinions of their members.

    The chairman of the trade union shall be equipped with the conditions of the Deputy rank of the party and government at the same level, and the Party member shall enter the leading group of the party organization at the same level.

    The vice chairman of full-time trade union shall be no less than the middle duty of the enterprise.



    Candidates for the chairmen of trade unions of private enterprises, foreign-invested enterprises, and Hong Kong, Macao and Taiwan investment enterprises shall be democratically recommended by members and submitted to the higher level trade unions for nomination.

    The candidate of the chairman of the enterprise union who has established the party organization must be examined by the party organization.

    The president of the trade union enjoys the treatment of deputy director of the enterprise.



    The chief executives, partners and their close relatives shall not be selected as members of the trade union committee of the enterprise.



    Twenty-fifth trade union chairmen and vice chairmen can be directly elected by the general assembly or the general assembly of members, or by the trade union committee of the enterprise.

    When a chairman of a trade union appears vacant, he shall be elected by election in a timely manner according to democratic procedures.



    Twenty-sixth the chairman of the trade union shall meet the following requirements:



    (1) strong political position and love of trade union work.


    (two) have the corresponding cultural level, laws and regulations and the knowledge of production and management.


    (three) style democracy, close ties with the masses, eager to serve members and workers.


    (four) there is a strong ability to coordinate labor relations and organize activities.



    The twenty-seventh functions of the chairman of an enterprise union are:



    (1) to convene a meeting of the trade union committee and preside over the daily work of the trade union.


    (two) participation in meetings involving the vital interests of employees and major issues related to production and operation, reflecting the wishes and demands of the staff, and putting forward the views of the trade union.


    (three) in the capacity of the chief representative of the worker's staff, representatives and organizations shall hold equal consultations with the enterprises and sign collective contracts.


    (four) represent and organize workers to participate in democratic management of enterprises.


    (five) to represent and organize workers and staff members to supervise enterprises in accordance with the law and implement labor safety and health laws and regulations, and seek to correct violations of the legitimate rights and interests of workers and trade unions.


    (six) acting as the director of the labor dispute mediation committee, presided over the work of the enterprise labor dispute mediation committee.


    (seven) report important information to higher level trade unions.


    (eight) to manage trade union assets and funds.



    Article twenty-eighth according to the law, the chairman and vice chairman of a trade union shall not arbitrarily mobilize their work when the term of office is not full.

    When the work needs to be mobilized, the trade union committee at the level and the trade union at the next higher level should be agreed.



    The chairman or vice president of a trade union must be convened to hold a general meeting or a member's Congress to discuss the matter.



    The duration of the labor contract of a full-time chairman, vice chairman or member of the trade union shall be extended automatically from the date of his appointment. The extension period is equivalent to that of his term of office. The term of the labor contract which has not yet been fulfilled is shorter than the term of office when the chairman of the full-time chairman, vice chairman or member is appointed, and the term of the labor contract is automatically extended to the expiration of the term of office.

    Except for serious personal negligence or statutory retirement age.



    The twenty-ninth new trade union trade union chairman and vice chairman should participate in the qualification or business training of the higher level trade union within one year.
