Nature And Activity Criteria Of Trade Unions
The status of trade unions in the state and society
The status of trade unions in the state and society refers to the position of trade unions in the national political, economic and social life.
It is mainly reflected by the role played by trade unions in the national political, economic and social life.
The status of China's trade unions is mainly reflected in three aspects: first, the mass organization of the working class, which is a voluntary combination of workers under the leadership of the Communist Party of China, is a bridge and link between the party and the workers and masses.
Through the trade unions, the party conveys the party's line, principles and policies to the workers.
At the same time, the opinions, suggestions and demands of the workers are fed back by the trade unions as the basis for the party's decision making.
This bridge and bond function of trade unions can not be replaced by any other organization or organization.
Second, trade unions are close partners of the government, important social pillars of the people's political power, and enjoy the right to participate in the management of state affairs, to manage economic and cultural undertakings and social affairs.
The trade unions assist the people's Government in carrying out their work and give full play to the role of trade union's democratic participation and social supervision in the process of exercising state administrative rights in order to safeguard the socialist state power led by the working class and the people's democratic dictatorship based on the alliance of workers and peasants.
Third, trade unions are the representatives and maintainers of the interests of members and workers, and are indispensable parties in coordinating labor relations.
It represents the workers and enterprises in an equal consultation and collective contracts, and presided over the daily work of the workers' Congress, so as to achieve the purpose of coordinating labor relations and safeguarding the workers' rights and interests and democratic rights.
With the continuous improvement of the marketization of labor relations in China, the role of trade unions in coordinating labor relations and safeguarding the legitimate rights and interests of workers will become more and more obvious. Their status will also become more and more prominent, and will become an important force in promoting reform, promoting development and maintaining stability.
The nature of trade union organizations
The second general provisions of the trade union law clearly stipulates: "trade unions are the mass organizations of the working class voluntarily combined."
This regulation clarifies the nature of trade union organizations from two aspects, one is class nature.
The trade union is the mass organization of the working class, representing and safeguarding the interests of the staff and workers.
The two is mass character. The trade union is an organization of workers and masses, not a political party or any other organization. As long as it is a manual laborer and a mental worker whose wages and incomes are the main source of life in enterprises, institutions and organs in China, they are entitled to participate in and organize trade unions regardless of race, race, sex, occupation, religion and education.
In addition, it is voluntary for workers to join trade unions and quit trade unions as workers' voluntary organizations.
The trade union must abide by and uphold the Constitution and take the constitution as the fundamental activity criterion.
The fourth provision of the trade union law stipulates: "trade unions must abide by and uphold the constitution, take the constitution as the fundamental activity criterion, take economic construction as the center, adhere to the socialist road, adhere to the people's democratic dictatorship, adhere to the leadership of the Communist Party of China, adhere to the Marx Lenin doctrine, Mao Zedong thought and Deng Xiaoping theory, persist in reform and opening up, and work independently and independently according to the trade union charter.
The National Congress of trade union members shall formulate or amend the articles of association of Chinese trade unions, and the articles of association shall not contravene the Constitution and laws.
This provision clearly defines the basic norms of trade union activities in the form of law.
The constitution is the fundamental law of our country. It embodies the will of the overwhelming majority of the people in China and has the highest authority and legal effect in our legal system.
The people of all nationalities, all state organs and armed forces, all political parties and social organizations and enterprises and institutions must take the constitution as a fundamental activity criterion and bear the responsibility of safeguarding the dignity of the Constitution and guaranteeing the implementation of the constitution.
As the mass organization of the working class as the foundation of the ruling party and the state power class, the trade union must also guide and regulate all activities of the trade union in accordance with the principles, spirit and specific provisions of the constitution.
Trade unions must abide by and uphold the Constitution and carry out activities within the scope of the Constitution and laws, so as to ensure that trade union work has a clear direction.
At the same time, the constitution embodies the will of the people and the protection of the interests of the people. Only by observing and upholding the dignity of the Constitution can the trade unions truly safeguard the fundamental interests of the workers and the masses.
We must uphold the party's leadership over trade unions.
The Communist Party of China is the vanguard of the Chinese working class. It is made up of the most advanced elements of the working class and is the core of leadership in building the great cause of socialism with Chinese characteristics.
As a mass organization of the working class, the trade union must adhere to the leadership of the party.
Only under the leadership of the party can China's trade unions and workers' movements maintain the correct political direction and advance along the right path.
The trade unions carry out their work independently according to the trade union statutes.
As a mass organization of the working class under the leadership of the party, the trade union must adhere to the leadership of the party and conscientiously implement the party's basic line and program. On the other hand, as a mass organization of the working class, the trade union should work independently according to its own nature, basic responsibilities and characteristics, in accordance with laws and trade union statutes.
The trade union accepted the leadership of the party and carried out its work independently and dialectically unified all aspects and activities of the trade union work.
Only in this way can we fully mobilize and give full play to the initiative, initiative and creativity of trade union organizations in order to better link closely with the masses of workers and staff, and give full play to the role of trade union organizations in the overall situation of reform, development and stability.
The relationship between trade unions and the people's Government
In China, trade unions and the people's government are mutually supportive, cooperative and closely related.
The people's government is a state administrative organ, undertaking the functions of managing state affairs and social affairs.
As a mass organization of the working class, the trade union should support its own government and assist the government in its work.
The government should rely on the working class wholeheartedly, and should listen carefully to the views of the trade unions and the broad masses of the workers, especially on the vital interests of the staff and workers.
The fifth, thirty-third and thirty-fourth articles of the trade union law stipulate that trade unions exercise the rights of participation granted by the state, represent employees' participation in the management of state and social affairs, and organize workers to carry out democratic management, democratic supervision, and participate in politics and politics.
This fully reflects that the trade union is an important social pillar of the state power and an important force to promote the development of the socialist market economy and an important supporter and partner for the people's government to leave.
