How Can Trademark Be Pferred?

Enterprises shall handle the procedures for the pfer of registered trademarks in time for merger, separation or merger.

If an enterprise has cancelled its trademark ownership, it will disappear.

A trademark assignor who registers the same or similar trademark on the same or similar commodity must be pferred together.

In applying for the pfer of a registered trademark, the pferor and the assignee shall jointly apply to the Trademark Office, and the pferee shall handle the application procedure for the pfer of the registered trademark.

After approving the application for pfer, the Trademark Office shall issue the corresponding notice of pfer and certificate of pfer to the pferor and the pferee.

Documents and materials to be provided:

1. A letter of attorney for trademark agency: entrusted by a trademark agency, a letter of attorney with a pferee's stamp must be provided.

If a pferee outside the mainland wants to apply for trademark pfer in China, it must entrust a trademark agency.

2. Application for the assignment of a registered trademark: the application for trademark pfer by a principal agent shall be made or sealed by the pferor and the assignee after the agency has made it.

3, the business license of the pferee or the photocopy of the supporting documents of the institution, association and other group organizations with legal person qualification.

The pferee is outside the mainland and does not need such documents.

4. Special reference materials:

1) when assigning a registered trademark for drugs, medical nutritious food, medical nutritious drinks and baby food, the pferee shall provide the documents of the health administration department, that is, the license for pharmaceutical production enterprises or the license for drug management enterprises, and have not yet obtained the above two certificates, and provide the approval document issued by the health administrative department to the establishment of a pharmaceutical production or business enterprise; if the pferor is used for the disinfectant trademark, the assignee shall provide a certificate of the health and epidemic prevention department.

2) pfer of trademarks of cigarettes, cigars and packaged tobacco shall be provided by the pferee.

Applicants outside mainland China do not need such documents.

3) if the enterprise fails to handle the pfer procedures in due course due to merger, separation or merger, the chapter stamp is invalid, and the pferor may not be stamped, but it must provide the effective documents of the competent authorities of the pferor or the supporting documents of the local administrative department for Industry and commerce.
