NOKIA China Unilaterally Laid Off 170 People Accused Of Violating Labor Laws

    NOKIA Layoffs Violate Labor Laws

Before global CEOElopStephen comes to China next Monday,

    NOKIA

Haste, a wave of layoffs in China.

In the morning of August 30th, in Yizhuang Office of NOKIA China, more than 29 employees refused to unilaterally terminate the agreement put forward by NOKIA's personnel department.

As early as 29, the joint letter had been sent to NOKIA's personnel department. However, according to the joint staff, NOKIA personnel department has repeatedly stressed that this act is "legitimate". NOKIA will eventually "oneway" (Dan Fangmian) to terminate the contract.

In response to the layoffs, Gong Wenfei, director of enterprise information in NOKIA China, told the daily economic news yesterday that this is not a so-called layoff, but a major strategic adjustment. For details, we need further information from the relevant departments.

Target audience: Saipan R & D Service Department has about 170 people.

According to the reporter, the "strategic adjustment" involves the development and Service Department of the NOKIA Symbian system, involving about 170 employees.

Since Apple launched iPhone in 2007, NOKIA's market value has shrunk by 2/3.

In April this year, NOKIA announced a huge layoff plan, which will lay off 4000 people by the end of 2012, mainly in Denmark, Finland and the United Kingdom, of which 1400 will be laid off in Finland, and layoffs will be completed by the end of 2012.

In addition, NOKIA will close many departments outside Finland, including the development department in Copenhagen and the US headquarters in New York.

In addition, through the development and service outsourcing of Saipan system, NOKIA has pferred about 3000 employees to Accenture, which will have about 7000 employees leaving NOKIA, accounting for almost 12% of NOKIA's global staff.

A NOKIA staff member who worked on the Saipan system, Xiao Zhang, told reporters that the layoffs were very sudden. Although NOKIA knew that the job of Saipan system would be adjusted because of NOKIA strategy, NOKIA China had never had a clear view of whether or not it would be laid off in the future.

Reporters learned in the interview that before June 24th, NOKIA China had not done any communication and consultation on the layoffs and the employees involved.

"Although we keep asking questions through the internal QA mailbox, there has been no definite information feedback."

In July 22nd, NOKIA China began announcing the pfer of China's Saipan R & D and service department to Accenture on its internal web page.

In July 29th, Accenture's personnel were escorted by NOKIA personnel to introduce employees' status and treatment to Accenture.

In August 3rd, the NOKIA human resources department issued 3 papers to the employees, namely, the dissolution of the labor contract with NOKIA, the three party agreement between NOKIA, Accenture and the dismissed employees, and the pfer of NOKIA to Accenture employees' contracts with Accenture.

The 3 documents obtained by reporters show that employees need to make a final reply on 10 working days (August 17th), that is, to agree to NOKIA's work arrangement, to terminate the labor contract with NOKIA, and turn to Accenture.

For those who are unwilling to work in Accenture, they must terminate the labor contract with NOKIA.

    labour

    Contract Law

Compared with NOKIA, Finland, the United States and the United Kingdom in the global region, NOKIA China has only given 10 days to the Chinese employees who have been laid off, and this has also aroused the suspicion of NOKIA's dismissed employees.

According to the dismissed employees, after his communication with colleagues in NOKIA, Finland, the United States and Britain, the area has been intervened by local trade unions, communicating with NOKIA on the details of layoffs, including the way of layoffs, compensation or the pfer of employees' rights and interests in Accenture.

Take the United Kingdom as an example, the trade union of NOKIA UK and NOKIA have at least 90 days' negotiation time for the layoffs.

On the other hand, for the employees who were laid off by NOKIA in August 3rd, two must be chosen one way, which would also make it difficult for the dismissed employees to accept it.

According to the above dismissed employees, just before, ElopStephen in the strategic interpretation of the global staff, in an internal mail, said: in 2011, because of strategic adjustment (halt Saipan), employees who lost their jobs should continue to pay wages from NOKIA to the end of 2011.

This also led the dismissed employees to think that the current layoffs of NOKIA personnel in China apparently violated the decision of NOKIA CEO.

    "NOKIA."

    Layoffs

Action has violated the labor contract law at least in procedure.

IT legal expert, China's Internet legal network chief legal adviser Zhao occupation told reporters.

"Judging from the number of layoffs and the reasons for layoffs, NOKIA's layoffs should be economic redundancies."

    Zhao Zhanling said.

According to the daily economic news reporter, according to the law, it is necessary to explain the situation to the trade union or all the staff 30 days in advance, listen to the opinions of the trade unions or workers, and report the layoffs to the labor administrative departments for the record, before they can lay off workers.

Zhao occupation pointed out that NOKIA gave only 10 working days to the dismissed employees, which obviously did not comply with the provisions of the labor contract law, unless otherwise paid one month's wages as a substitute notice.

However, Gong Wenfei did not recognize the economic layoffs. She thought it was NOKIA's strategic adjustment, and NOKIA had provided new jobs for employees.

Regarding the refusal of employees pferred to Accenture to question the details of NOKIA's illegal layoffs, Gong Wenfei said that there was no relevant information at present, and the relevant departments needed to be further informed about the situation.
