According to the anti dumping regulations of the People's Republic of China (hereinafter referred to as " Anti-dumping According to the regulations, in May 10, 2013, the Ministry of Commerce (hereinafter referred to as the investigation organ) issued the Announcement No. twenty-fourth of the year, and decided to investigate anti-dumping cases concerning the imported high temperature pressure bearing alloy steel seamless steel tubes (hereinafter referred to as the investigated products) originating in the European Union, Japan and the United States. The product under investigation is in the People's Republic of China import and export tariff code: 73045110, 73045190, 73045910 and 73045990, and other steel pipe products which do not conform to the specific products described in the above tariff code do not fall within the scope of this investigation.

The investigation authorities investigated the cause and effect of dumping and dumping margin on the products under investigation, whether China's high temperature pressure bearing alloy steel seamless steel tube industry was damaged or damaged, and the causal relationship between dumping and damage. According to the findings of the investigation and the twenty-fourth provision of the anti dumping regulations, in December 13, 2013, the investigation authorities issued a preliminary notice to identify the dumping of the products under investigation. China's related high temperature pressure bearing alloy steel seamless steel tube industry suffered substantial damage, and there was a causal relationship between dumping and real damage.

After the preliminary ruling, the investigation agency continued its dumping and dumping The magnitude, extent of damage and damage, and the causal relationship between dumping and injury are investigated. At the end of the investigation, according to the twenty-fifth provision of the anti-dumping regulations, the investigation organ makes the final ruling (see Annex). The relevant matters are hereby announced as follows:

　 I. to terminate the anti-dumping investigation of imported products originating in Japan.

According to the survey, the proportion of the surveyed products exported to China in the survey period accounted for less than 3% of the total number of products imported into China during the same period. Therefore, according to the provisions of the ninth and twenty-seventh provisions of the anti dumping regulations, the investigation organ finds that the quantity of the export is negligible, and decides to terminate the anti-dumping investigation of the imported products originating in Japan and take no anti-dumping measures.

Two. Final ruling on imported products originating in the European Union and the United States

After investigation, the investigation authorities finally ruled that during the investigation period, dumping products were found in the European Union and the United States, and China's high temperature pressure bearing alloy steel seamless steel tube industry was substantially damaged, and there was a causal relationship between dumping and material damage.

　 Three, impose anti-dumping duties.

In accordance with the relevant provisions of the anti-dumping regulations, the Ministry of Commerce has proposed the proposal of levying anti-dumping duties to the Customs Tariff Commission of the State Council. The Customs Tariff Commission of the State Council made a decision according to the recommendation of the Ministry of Commerce. Since May 10, 2014, anti-dumping duties have been imposed on the seamless steel tubes imported from the EU and the United States.

The products under investigation are as follows:

Scope of investigation: originating from European Union Related to the import of the United States, the alloy steel seamless steel pipe for high temperature and pressure bearing.

Name of the product under investigation: high temperature and pressure bearing alloy steel seamless steel tube, also known as P92 seamless steel tube, 10Cr9MoW2VNbBN seamless steel tube, X10CrWMoVNb9-2 seamless steel tube, etc.

English Name: Certain Alloy-Steel Seamless Tubes and Pipesfor High Temperature and Pressure Service.

Specific description: the outer diameter is above 127mm (containing 127mm), the content of carbon (C) in chemical composition (wt%) is greater than or equal to 0.07, and the content of carbon (C) is less than or equal to 0.13, the content of chromium (Cr) is greater than or equal to 8.5, and the content of molybdenum (Mo) is greater than or equal to 0.3, and the content of molybdenum (Mo) is greater than or equal to 0.6, and the content of tungsten (W) is greater than or equal to 1.5, less than or equal to 2, tensile strength is greater than or equal to 620MPa, and yield strength is greater than or equal to 440MPa of alloy steel seamless steel tube, whether or not it is further processed.

Main application: the alloy steel seamless steel tube with high temperature and pressure bearing has strong high temperature strength and creep resistance. It is mainly used for supercritical, ultra supercritical power plant boilers and power station steam water pipes.

The product is classified in the People's Republic of China import and export tariff code: 73045110, 73045190, 73045910 and 73045990. Other steel pipe products that do not conform to the specific products described in the above tariff code do not fall within the scope of this investigation.

Four, the method of levying anti-dumping duty.

Since May 10, 2014, importers should pay corresponding anti-dumping duties to the People's Republic of China customs when importing seamless steel tubes with high temperature and pressure bearing alloy steel originating in the European Union and the United States. The anti-dumping duty is calculated according to the customs value approved by the customs value. The formula is: anti-dumping duty = customs duty paid price * anti-dumping duty rate. The value added tax of import is assessed by customs value approved customs value plus customs duties and anti-dumping duties.

　 Five. Retroactive collection of anti-dumping duties.

For the period from January 10, 2014 to the date of the announcement of the decision, the margin provided by the importers to the People's Republic of China customs in accordance with the preliminary notice shall be assessed and transferred to the anti-dumping duty according to the scope of the anti-dumping duties and the anti-dumping duty rate as determined by the final judgment, and the value-added tax of the import link shall be levied according to the corresponding value-added tax rate. During this period, the part of the margin provided by the importer is beyond the anti-dumping duty, and the value-added tax part of the imported import tax shall be refunded.

No anti-dumping duties will be imposed on imported seamless steel tubes with high temperature and pressure bearing alloy steel originating in the EU and the United States before January 9, 2014.

Six. The time limit for levying anti-dumping duties.

The anti-dumping duty is imposed on the seamless steel tubes with high temperature and pressure bearing alloy steel originating in the European Union and the United States. The implementation period will be 5 years from May 10, 2014.

　 Seven. New exporters review

For the new exporters of the EU and the United States who did not export the products to People's Republic of China during the survey period, those who met the requirements may apply to the investigation authorities for new review of the exporters in accordance with the provisions of the forty-seventh provision of the anti-dumping regulations.

Eight, mid-term review

During the period of levying anti-dumping duties, the interested parties may apply in writing to the investigating authorities for interim review in accordance with the provisions of the forty-ninth provision of the anti dumping regulations.

　 Nine, administrative reconsideration and administrative litigation.

In accordance with the provisions of the fifty-third provision of the anti dumping regulations, the administrative reconsideration may be filed in accordance with the provisions of the "anti-dumping regulations", and it can also be brought to the people's court according to law.
