China'S Foreign-Related Legal Market Expands Opportunities For Professional Returnees.
China
Huge demand for Foreign Affairs
Liu Guofu, a professor of Law School of Beijing Institute of Technology and an advisory committee member of the overseas Chinese Affairs Office of the State Council of China, analyzed this. In recent years, China's internationalization process has further accelerated, and the demand for foreign-related legal services industry is increasing.
Liu Guofu said, "foreign legal services include many levels, which are two-way, including" going out "and" bringing in ".
Chinese Enterprises
In economic disputes arising from trade, Chinese citizens have disputes over overseas travel, study abroad, immigration and investment, or disputes between overseas people in China or territorial disputes between China and other countries.
Zhou Hai Bo, a lawyer of Shanghai Chuang Chuang law firm, who has many years' experience in commercial litigation, contract disputes and foreign investment legal affairs, also said that the main foreign legal services are concentrated in the non litigation business. For example, the establishment of foreign enterprises in China from the establishment to the later stage of operation requires foreign lawyers to provide legal consultancy services. "In the registration stage of foreign-funded enterprises, they need to complete various legal documents for them, and when enterprises enter the operational stage, they also need to provide legal advice and risk analysis for them to complete the contracts needed in the operation process."
Wang Xuehua, a partner of the law firm in China and member of China International Economic and Trade Arbitration Commission, has been actively involved in foreign-related legal work in the field of anti-dumping, import and export control and foreign investment for many years.
He said that from the perspective of industrialization, China's development of foreign-related legal services will also promote the development of plation, stenographer, hotel and other service industries.
Foreign clients
Multiple selection of foreign law firms in China
Zhou Haibo believes that there are two main problems in China's foreign-related legal services industry.
First, China's overall rule of law is not good enough. Some foreign-related economic disputes have been sentenced and foreign businessmen can not get compensation.
Two, the professional level of foreign-related legal workers is not strong. Most foreign clients will choose foreign law firms in China to solve their legal affairs, and few will choose to find small and medium-sized foreign-related law firms in China.
Wang Xuehua also believes that the decision to vigorously advocate "rule by law" is a great guarantee for the development of Chinese law firms for foreign-related businesses.
He also pointed out that Chinese enterprises should enhance their awareness of the law. "Many Chinese enterprises will have trade disputes in overseas investment. If they hire lawyers to protect their rights and interests before, during or after the event, they will be more beneficial to themselves, but many enterprises will not do so if they consider the cost issue."
Wang Xuehua also said that the formulation and renewal of China's foreign related laws and regulations should be in line with the international community.
"Some of China's foreign related laws, especially those related to economic and trade laws, should conform to the requirements of international economic integration in the reform and opening up to the outside world, and formulate and update laws and regulations that conform to international practices and international standards at any time."
For example, he said that in recent years, more and more cases involving foreign arbitration have been committed in China, but nearly 20 years since the entry into force of the Arbitration Law of China, part of the provisions of the law are urgently needed to be revised and perfected so as to connect with the international community.
Liu Guofu also believes that China needs to establish and improve its foreign-related legal system, especially in foreign-related legal systems such as two-way investment, entry and exit, and overseas Chinese.
