Notice on printing and issuing "work plan for special rectification of trademark printing"

District (city) bureaus and sub Bureaus:

In order to carry out the implementation plan of the Provincial Bureau to carry out the special rectification of trademark printing and crack down on trademark infringement from the source, further improve and perfect the long-term mechanism for trademark protection, and curb trademark infringement from the source, the Municipal Council has decided to carry out special rectification actions for trademark printing in the city.

Work plan for special rectification of trademark printing

I. mission objectives

Through the special rectification of trademark printing, we should focus on combating illegal activities in the field of trademark printing, comprehensively standardize the order of trademark printing, make the main body qualification of the trademark printing units in the city legal and effective, implement relevant systems, print legal norms, and establish and improve the long-term supervision mechanism for trademark printing.

The rectification work is based on educational norms and case investigation.

(1) to engage in trademark printing without any evidence;

(two) forging or unauthorized manufacture of registered trademarks of others and the sale of forged or unauthorized trademarks of registered trademarks;

(three) unauthorized manufacture of special marks in World Horticultural Exposition and sales of World Horticultural Exposition special marks made without authorization;

(four) illegal printing, selling and packaging of other well-known commodities;

(five) the trademark printing unit violates the provisions of the trademark printing business and has not been corrected after repeated investigations and education.

Three. Work steps

The working hours are divided into four stages from March to November.

(1) the investigation phase (March 15th to May 31st).

The district (city) bureaus and sub bureaus shall, in accordance with the territorial jurisdiction principle, conduct a comprehensive investigation and investigation of the units engaged in trademark printing in the jurisdictions through inquiring the registration information and visiting surveys, etc., and improve the electronic registration ledgers of the trademark printing units in the jurisdiction area, fill out the register of trade marks (Annex 1), instruct the trademark printing units to set up trademark supervisors, clarify their trademark management responsibilities, and set up a team of trademark supervision units for trademark printing units in their respective jurisdictions.

The act of engaging in trademark printing without license and without license is punished in accordance with relevant laws and regulations.

(two) self inspection stage of Education (June 1st to August 31st).

The unified organization of the trademark printing unit and the trademark supervisor shall carry out special training in trademark printing, and explain the relevant provisions of the trademark law, the trademark law implementation regulations, the trademark printing management regulations and the Shandong trademark printing management standard, and ensure that every printing unit has at least 2 people to participate in training, and the training is credited to the unit credit archives.

It is necessary to carry out self inspection and self correction in printing time limit and implement the management standard of trademark printing.

(three) review and deepen phase (September 1st to October 31st).

All districts (cities) bureaus and sub bureaus shall review the situation of self inspection and self correction of trademark printing units.

The contents of the review include: check the relevant license, see whether the main qualification of the printing shop is legal and effective, whether there is a super scope or unlicensed business behavior; check the "trademark printing business registration form", "trademark identification finished product out of storage registration form", "trademark identification of waste and inferior products destruction registration form" and "printing plate and mold registration form" and so on, to see whether the trademark printing management system is sound implementation; on-site inspection printing workshop, finished goods warehouse, scrap goods stacking place, used templates and film, printing the dealer's delivery list, delivery voucher and so on, to see whether there is any violation of the provisions of the trademark printing behavior.

It is necessary to focus on the inspection of illegal printing businesses in urban and rural areas and remote rural areas.

If the reexamination fails, the deadline for rectification shall be rectify. If the rectification is still not qualified, it shall be dealt with in accordance with the regulations on the administration of the printing of trademarks.

Trademark infringement shall be dealt with according to the trademark law.

(four) summary acceptance stage (November 1st to November 30th).

Industrial and commercial organs at all levels analyzed the special rectification work of trademark printing, summed up experience, analyzed and analyzed cases, and studied improvement measures.

The district (city) bureaus and sub bureaus shall submit the special rectification work to the Municipal Council before November 25th, summarizing the situation, data and analysis, and putting forward the following work plans and suggestions.

In the light of the actual situation of the area, we should work out a rectification action plan and strengthen organizational leadership.

According to the measures for the administration of trademark printing, trademark printing includes printing, printing and dyeing, plate making, lettering, weaving, drying, ironing, casting, stamping, hot stamping and applique.

Three is to strengthen case investigation.

On the basis of different illegal nature, the regulation of trademark printing should be determined in accordance with the law of the different illegal nature, and the trademark printing system is not perfect, should be corrected in a time limit, and supervise it to perfect the relevant system; it should be strictly investigated and dealt with in accordance with the law, criminal law should be investigated and punished strictly, the criminal law should be punished by law, and the criminal responsibility of the criminal law should be violated.

Four is to strengthen the work of supervision.

The city council will strengthen the supervision and inspection of the special rectification work in various districts and municipalities, and regularly inform the progress of work every month to ensure that the rectification work is carried out in an orderly way.

Each unit should fill in the Bi monthly report on the special rectification of trademark printing (Annex 2) according to the requirements, and briefly report the progress of the work of last month and investigate the cases of major cases before 5 days of each month.

The summary of each unit's special rectification work should be submitted to the Trademark Office of the City Council before November 25th.
