Announcement On Implementation Of New Tariff And Quota Management System For New Wool And Wool And Australian Wool Imports In 2019
Recently, the Ministry of Commerce and the General Administration of Customs issued the implementation details of the 2019 national tariff quota for the import of wool and wool and Australian wool in the New Zealand (hereinafter referred to as the national tariff quota).
The announcement is as follows:
I. total tariff quotas
In 2019, the total tariff quotas were: 36936 tons of New Zealand wool, 665 tons of New Zealand wool and 34729 tons of Australian wool.
Two, the principle of distribution
The country's tariff quotas are allocated first and first by contract.
When the total number of Issued Amounts reached the total amount of tariff quotas in 2019, the Ministry of Commerce and the competent departments of Commerce of the provinces, autonomous regions, municipalities directly under the central government, cities under separate planning and the Xinjiang production and Construction Corps (hereinafter referred to as the Ministry of Commerce) entrusted to stop accepting applications.
Three. Application conditions
In 2019, the basic conditions for applicants for tariff quotas in the country were: before January 1, 2019, they were registered in the market supervision and management department; they had good financial status, tax records and integrity; since 2018, there were no illegal, illegal and dishonest records in business, customs, foreign exchange, market supervision, taxation, social security, environmental protection, and safety in production. They did not violate the Interim Measures for the management of import tariff quotas of agricultural products and the implementation rules for the import of tariff quotas for wool and wool in 2018.
On the premise of having the above conditions, the applicant of the country's tariff quota must also meet one of the following requirements:
(1) enterprises holding the 2018 country tariff quotas and having import actual performance (excluding agency import) (hereinafter referred to as applicants with performance);
(two) wool and wool textile production enterprises with the annual processing capacity of 3000 tons and above (hereinafter referred to as non performance applicants).
Four, application materials
(1) the country tariff quota application form can be obtained from the entrusted Department of the Ministry of Commerce or downloaded from the website of the Ministry of Commerce (http://www.mofcom.gov.cn/).
(two) import contract for wool and wool tops;
(three) the approval document or archival filing document of the construction project and the completion acceptance report (provided by the applicant without performance report).
Five, country tariff quotas apply
Applicants with actual performance may apply for country tariff quotas several times during the year, but the total number of applications before September 30, 2019 will not exceed the number of imports under the same trade mode in 2018.
The total quantity of imports is calculated according to the quantity of the import tariff quota certificate of agricultural products, which is received by the Ministry of Commerce and entrusted by the Ministry of Commerce, and is then certified by the Ministry of Commerce's import tariff quota management system (hereinafter referred to as the management system) and signed by the customs.
Six, redistribution of tariff quotas
After September 30, 2019, the Ministry of Commerce redistributed the remaining available quantity.
Those who have completed the fifth specified quantities and those who are eligible for non performance can submit a quota redistribution application and serve the entrusted Department of the Ministry of Commerce before September 20, 2019.
The Ministry of Commerce commissioned the company to apply for service to the Ministry of Commerce (administrative service hall) before September 30, 2019, and uploaded the information to the management system.
Overdue will no longer be accepted.
The application enterprises approved by the Ministry of Commerce may continue to apply for import quotas, and the number of applications shall not exceed the approved quantity.

Seven, the issuance of the country's tariff quota certificate.
After receiving the completed application, the MOFCOM will inform the entrusted Department of the Ministry of Commerce within 5 working days.
The Ministry of Commerce has issued a "tariff quota certificate for agricultural products" to the end-users within 5 working days. The quotas of New Zealand wool and wool should be clearly marked in the quotas, and the "Australian wool country quotas" should be clearly marked.
If the system fails to issue the certificate, the management system will recover the number of applications and deduct the number of applications that the enterprise can apply for.
Eight, customs tariff certificate, customs inspection.
When importing a country's tariff quota holder, it is necessary to declare to the customs the number of washed / fixed quantity of imported wool and wool, and submit the relevant import tariff quota certificate for agricultural products.
The customs agreement can be applied to the agreement on tariff rates of the free trade agreement, and if it is not in conformity with the relevant provisions of the free trade agreement, the most favored nation tax rate or general tax rate shall apply.
Nine, country tariff quota certificate period
The import tariff quota certificate for agricultural products shall be valid within 3 months from the date of issue, and shall not exceed December 31, 2019 at the latest.
For the goods shipped from the original port of shipment before December 31, 2019, which need to be delivered in the next year, the holders of the country's tariff quotas should apply for the extension to the Ministry of Commerce's entrustment before December 31st, with the shipping documents and the effective import tariff quota certificate of agricultural products, and the extension of the import tariff quota certificate for agricultural products will not exceed February 29, 2020 at the latest.
Ten, refund and cancellation of tariff quotas.
(1) within the period of validity of the import tariff quota certificate for agricultural products, the country tariff quota holders do not use or do not run out of the country tariff quotas which have been applied, and the original of the tariff quota certificate shall be returned to the entrusted Department of the Ministry of Commerce issuing the certificate.
The entrusted Department of the Ministry of Commerce shall promptly cancel the number of the used quantity in the management system and return it to the unused quantity. At the same time, it should be noted and retained for reference in the original remarks column of the corresponding import tariff quota certificate for agricultural products.
The Ministry of Commerce reclaims the remaining quotas listed in the tariff quota certificate and takes into account the allowance for tariff quotas.
The date of the latest tariff quotas not to be completed may not exceed September 15, 2019.
Those who fail to make the return are deemed to have failed to complete the import, and the amount of their applications can be deducted in 2020.
(two) the holder of the country's tariff quota shall, within 20 working days after the customs clearance of the imported goods is completed, submit the original part of the import tariff quota certificate of the agricultural products (the consignee through customs formalities) to the entrusted Department of the Ministry of Commerce.
The entrusted Department of the Ministry of Commerce needs to cancel the management system in time and keep the original.
The date of cancellation of the import tariff quota certificate for agricultural products should not exceed March 31, 2020 at the latest.
Those who fail to write off the time will be deemed to have failed to complete the import, and the amount of their applications can be deducted in 2020.
Eleven. Penalties
The applicant shall bear the main responsibility for the authenticity of the materials and information submitted by him. He shall not have any concealment or false information. If the application materials and information are not verified by verification, the applicant shall be disqualified.
If a counterfeit contract or related material is used to defraud the import tariff quota certificate of agricultural products, the Ministry of Commerce and its entrusted agency will not accept the application of their country tariff quota unless they collect their quota certificate in accordance with the law.
Those who forge, alter or trade the certificate of import tariff quota for agricultural products shall be investigated for criminal responsibility according to law.
