Three Ministries And Commissions On Adjustment Of Leather Processing Trade Policy

In accordance with the needs of national economic development and with the approval of the State Council, the trade policy on processing trade of raw skins is now adjusted.

First, continue to prohibit the import of raw leather (commodity code: 4101-4103, see Annex 1) directly export processing trade of semi finished leather and finished leather, allow processing trade business of imported semi finished leather (commodity code: 4104-4106, see Annex 1) to export finished leather.

Two, the following circumstances permit processing trade to import raw leather to carry out related businesses:

(1) the imported raw skins are processed directly into leather products and then re exported.

(two) after imported raw leather is processed into semi finished leather or finished leather, it will be pferred directly to the downstream leather products enterprises directly or through the special supervision areas of the customs.

(three) after the processing of imported raw leather is made into semi finished leather or finished leather, it will be exported to the bonded areas and export processing zones.

Three. When an enterprise applies to the provincial commerce department to apply for the import and processing trade of the above-mentioned raw materials, it shall also provide the following materials in addition to submitting relevant materials according to the regulations:

(1) a contract or agreement for the export or further processing of manufactured goods.

(two) the certificate of environmental protection assessment of raw leather processing trade enterprises issued by the provincial environmental protection department at the locality of the enterprise (see Annex 2).

If the enterprise fails to provide the two basic materials at the same time, the competent commercial department shall not accept the application for processing trade business of the enterprise.

Four, the provincial environmental protection departments at the locality of processing enterprises must strictly assess the processing trade enterprises of raw skins in accordance with the detailed rules for the environmental protection assessment of the processing trade enterprises (see trial 2), and issue the certificate of environmental protection assessment for the processing trade enterprises that meet the requirements, and organize the spot checks every three months or irregularly.

Five, the customs shall, according to the "processing trade approval certificate" issued by the provincial commerce department, the processing capacity certificate issued by the competent commercial department at the place where the processing enterprise is located, the certificate of environmental protection for the processing trade enterprises issued by the provincial environmental protection department at the place where the processing enterprise is located, and the contract or agreement for the export or further processing of the finished products, the enterprise shall handle the filing procedures for the processing trade of the raw leather and supervise it.

Six, the total volume control and total import control should be applied to the processing trade of raw skins.

New enterprises that do not carry out imported leather processing trade before 2005, and those enterprises that have really expanded the demand for raw leather imports, must apply to the provincial commerce department and pfer it to the Ministry of Commerce.

Seven, the processing trade enterprises that carry out computer network supervision shall apply for processing trade business one by one in accordance with the above provisions.

Eight, export processing zones, bonded areas and other special areas of customs supervision shall not carry out any form of import processing trade.

Nine. The notice will be implemented from the date of promulgation. The Ministry of Commerce, the General Administration of customs and the environmental protection administration of the people's Republic of China ([2006]390), the Ministry of Commerce, the General Administration of customs, the environmental protection administration Announcement No. sixty-third of 2006, and the Ministry of commerce and the General Administration of Customs on the import and export of raw leather processing trade ([2006]65) will be abolished simultaneously.
