關(guān)于在領(lǐng)海和港口內(nèi)使用國際海事衛(wèi)星船舶地面站的國際協(xié)議(附英文)

     序　言
　　本協(xié)議各締約國（下稱“各締約國”），
　　為達(dá)到１９７５￣１９７６年建立國際海事衛(wèi)星系統(tǒng)國際會議的第３號建議中所設(shè)想的目標(biāo)，并
　　已決定改進(jìn)海上遇險(xiǎn)和人命安全通信以及船舶的效率和管理，
　　茲協(xié)議如下：
　　第１條
　?。ǎ保└鶕?jù)本協(xié)議的規(guī)定和國際法所確立的航行權(quán)，各締約國，在其領(lǐng)海和港口內(nèi)，應(yīng)許可經(jīng)批準(zhǔn)而適合國際海事衛(wèi)星組織（ＩＮＭＡＲＳＡＴ）所提供的海上空間段通信系統(tǒng)并正確安裝在懸掛其他締約國國旗的船上的船舶地面站（下稱“國際海事衛(wèi)星船舶地面站”）進(jìn)行操作。
　?。ǎ玻┐朔N許可，任何時候僅限于國際海事衛(wèi)星船舶地面站使用衛(wèi)星海上移動頻率，并且國際海事衛(wèi)星船舶地面站要符合國際電信聯(lián)盟的適用的無線電規(guī)則以及本協(xié)議第２條所規(guī)定的條件。
　　第２條
　?。ǎ保﹪H海事衛(wèi)星船舶地面站的操作必須符合下列條件：
　?。ǎ幔┢洳僮鞑坏糜袚p于沿海國的和平、良好秩序和安全；
　　（ｂ）其操作不得對沿海國領(lǐng)土邊界以內(nèi)的其它無線電業(yè)務(wù)操作產(chǎn)生有害干擾；
　?。ǎ悖└鶕?jù)有關(guān)的國際公約，特別是根據(jù)國際電信聯(lián)盟的無線電規(guī)則，對于遇險(xiǎn)和安全通信必須給予優(yōu)先權(quán)；
　　（ｄ）按有關(guān)的安全規(guī)定，在存有爆炸性氣體的區(qū)域內(nèi)，特別是在裝卸油類和其它易燃物質(zhì)的過程中，使用國際海事衛(wèi)星船舶地面站，必須采取安全措施；
　?。ǎ澹┰诓挥绊憞H法所確立的航行權(quán)的情況下，國際海事衛(wèi)星船舶地面站在沿海國主管部門的要求下應(yīng)接受檢查。
　?。ǎ玻┰诒緟f(xié)議中，“沿海國”系指根據(jù)本協(xié)議的規(guī)定，國際海事衛(wèi)星船舶地面站在其領(lǐng)海和港口內(nèi)操作的國家。
　　第３條
　　在不影響國際法所確立的航行權(quán)的情況下，各締約國可以限制、中止或禁止在其規(guī)定的港口和領(lǐng)海區(qū)域內(nèi)使用國際海事衛(wèi)星船舶地面站。在不影響所確定的這種限制、中止或禁止的生效的情況下，締約國應(yīng)盡速將這種決定通知本協(xié)議的保存者。
　　第４條
　　在不影響遇險(xiǎn)和安全通信的情況下，本協(xié)議第１條（１）款中所述的許可，可限于船旗國按第１條（１）款的規(guī)定所給予有關(guān)沿海國船舶在其領(lǐng)海和港口內(nèi)的權(quán)利。
　　第５條
　　本協(xié)議的任何條款不得被解釋為阻止某一締約國給予國際海事衛(wèi)星船舶地面站的操作以更大的便利。
　　第６條
　　本協(xié)議不適用于軍艦和其它用于非商業(yè)目的的政府船舶。
　　第７條
　　（１）任何國家可以通過下列方式成為本協(xié)議的締約國：
　　（ａ）簽字；或
　?。ǎ猓┯写鷾?zhǔn)、接受或核準(zhǔn)的簽字，然后再予批準(zhǔn)、接受或核準(zhǔn)；或
　　（ｃ）加入或參加。
　?。ǎ玻┍緟f(xié)議自１９８６年１月１日起到其生效時為止，在倫敦開放供簽字，此后繼續(xù)開放供加入或參加。
　　第８條
　?。ǎ保┍緟f(xié)議在二十五個國家成為締約國之日后第三十天起生效。
　　（２）對于在本協(xié)議生效后交存批準(zhǔn)書、接受書、核準(zhǔn)書、加入書或參加文件的國家，本協(xié)議應(yīng)在交存文件之日起對其生效。
　　第９條
　　締約國可隨時通知保存人退出本協(xié)議。該項(xiàng)退出應(yīng)在保存人收到締約國的書面退出通知書之日后第九十天起生效。
　　第１０條
　?。ǎ保﹪H海事衛(wèi)星組織總干事為本協(xié)議的保存人。
　　（２）保存人應(yīng)將下列情況迅速通知本協(xié)議的所有締約國：
　?。ǎ幔┍緟f(xié)議的任何簽字；
　?。ǎ猓┍緟f(xié)議生效日期；
　?。ǎ悖┤魏闻鷾?zhǔn)書、接受書、核準(zhǔn)書、加入書或參加文件的交存；
　?。ǎ洌┠骋粐彝Ｖ棺鳛楸緟f(xié)議締約國的日期；
　?。ǎ澹┤魏斡嘘P(guān)本協(xié)議的其它通知和聯(lián)系。
　　（３）本協(xié)議一經(jīng)生效，保存人應(yīng)按《聯(lián)合國憲章》第１０２條將一份核證無誤的副本送交聯(lián)合國秘書長以供登記和公布。同時，保存人須分別將本協(xié)議一份核證無誤的副本送交國際電信聯(lián)盟和國際海事組織。
　　第１１條
　　本協(xié)議正本一份，用英文、法文、俄文和西班牙文寫成。所有文本具有同等效力，由保存人保存。保存人須將核證無誤的副本分送所有締約國。
　　下列具名者均經(jīng)各自政府正式授權(quán)，特簽署本協(xié)議＊，以昭信守。

     Preamble 
   The States Parties (hereinafter referred to as "Parties") to this Agreement, Desiring to achieve the objectives envisaged in Recommendation 3 of the International Conference on the Establishment of an International Maritime Satellite System, 1975-1976,　and Have decided to improve the distress and safety of life at sea communications, and the efficiency and management of ships,Having agreed as follows:　
　
    Article 1　
　(1) Pursuant to the provisions set forth in this Agreement and in accordance with navigational rights established under international law,Parties shall permit in their territorial seas and ports the operation of approved ship earth stations appertaining to the maritime space communication system provided by the International Maritime Satellite Organization (INMARSAT)　and properly installed aboard ships flying the flag of any other Party  (hereinafter referred to as "INMARSAT Ship Earth Stations").
　(2) Such permission shall at all times be restricted to the use of maritime mobile-satellite frequencies by the INMARSAT Ship Earth Station and shall be subject to compliance by the INMARSAT Ship Earth Station with the applicable Radio Regulations of the International Telecommunication Union and the conditions set forth in Article 2 of this 
Agreement.　
　　
   Article 2　
　(1) The operation of INMARSAT Ship Earth Stations shall be subject to the following conditions:
　(a) it shall not be prejudicial to the peace, good order and security of the Coastal State;
　(b) it shall not cause harmful interference to other radio services operating within the boundaries of the Coastal State"s territory;
   (c) it shall give priority to distress and safety transmissions in accordance with relevant international conventions and, in particular, the Radio Regulations of the International Telecommunication Union;
   (d) safeguard measures shall be taken, subject to relevant safety regulations, during the operation of INMARSAT Ship Earth Stations in an area containing the presence of explosive gases, in particular during operations relating to oil and other inflammable  substances;
   (e) INMARSAT Ship Earth Stations shall be subject to inspection by the authorities of the Coastal State at the latter"s request, without prejudice to the navigational rights established under international law.
   (2) In this Agreement, "Coastal State" means the State in whose territori
