    In order to implement the "industrial injury insurance Ordinance", reasonably determine the premium rate of industrial injury, promote industrial injury prevention, and achieve industrial injury insurance cost and social assistance, the State Council has approved the following questions:


    I. division of industries


    According to the degree of industrial injury risk in different industries, we classify the industry into three categories according to the classification of national economy (GB/T4754--2002): one is a less risky industry, the two is a medium risk industry, and the three is a riskier industry.

    There are three kinds of work-related injuries in three industries.

    Insurance payment

    Rate.

    The overall regional social insurance agencies should be registered according to the industrial and commercial registration of the employing units.

    Operation and production

    The business risk category of each unit is determined separately.

    If the employing units belong to a category of industries, they shall be paid according to the benchmark rate of the industry, and no floating rate shall be imposed.

    The employing units belong to two or three categories, and the rates are fluctuated.

    The initial payment rate of the employer shall be determined according to the standard rate of the industry, and the social insurance agency in the overall planning area shall float once or three years according to the employer's work injury insurance premium, the incidence of work-related injury and the degree of occupational hazards.

    On the basis of the industry benchmark rates, the two flights can be moved up and down: the first to the first level of the industry, the 120% of the benchmark rate of the industry, the second tier to 150% of the benchmark rate of the industry, the first to the 80% of the benchmark rate of the industry, and the second to the 50% of the benchmark rate of the industry.

    The specific measures for floating rates should be formulated by the labor and social security administration departments in all regions, together with the financial, health and safety supervision departments.


    All localities should do a good job in calculating the relevant data of work-related injury insurance, reasonably determine the benchmark rate of industry, and formulate a specific method for floating rate.

    We should strengthen the monitoring of the operation of industrial injury insurance, and regularly analyze the impact of industrial injury insurance rates on the operation of industrial injury insurance system, and timely report major issues.

    We will regularly understand the situation of work-related injury insurance fund receipts and payments, and promptly put forward a plan to adjust the industry differential rate and intra industry premium rate, and submit it to the State Council for approval.
