A Brief Account Of Registered Trademarks In Hongkong
The registry started operation in 1874 and is one of the oldest trademark registries in the world.
In addition to being responsible for the registration of trade marks, Hongkong has registered more service marks since 1992.
From April 1996 to March 1997, the number of applications received by the Trade Marks Registry amounted to 16708, and the number of applications has steadily increased over the past few years.
Trademark registration
If the applicant applies for the registration of the new trademark, if the criteria set forth in the trademark Ordinance are met, the notice will normally be received within ten months, and the notice can be published for the trade mark.
Subsequently, if the public has legal grounds, they may raise objections within the statutory period of two months.
If there is no objection, the trademark may be registered after two months.
Therefore, if no objection is raised, the whole registration process will take about 14 months.
The validity period of a registered trademark protected by the law is calculated from the date of receipt of the valid application by the Hongkong Trademark Registry.
Applicable international conventions
Since the Paris convention is extended to the Hongkong Special Administrative Region and China Hongkong is a member of the world trade organization, the application of the trademark applicant in the Hongkong special administrative region can enjoy the priority of the Paris convention.
Proposed new trademark legislation
The Hongkong Special Administrative Region (HKSAR) plans to substantially amend the local trademark legislation in 1998.
The government has published the proposed new legislation and consulted the public.
The proposed legislation, if passed, will simplify the procedures for application and review. According to the new legislation, the types of marks that can be registered as trademarks will be increased.
For example, voice and fragrance can be registered, trademark pfer and licensing procedures will be simplified, and registration applications involving more than one category of trademarks will be accepted.
