Third delivery and acceptance

Settlement of fourth payments

Fifth Party B's liability for breach of contract:

1, Party B can not deliver the goods, Party A does not pay to Party B.

Party B shall pay the liquidated damages equivalent to 10% of the amount of the goods that can not be delivered to Party A.

2. The type, quantity, specification and quality of the goods submitted by Party B are not in conformity with the laws and regulations of the state and the contract stipulations. Party B shall be responsible for the repair, replacement or return of the goods, and bear the actual cost paid therefrom.

3. If Party B fails to deliver the goods over time, it shall pay to Party A 5/1000 of the penalty amount per day according to the part of the payment of the overdue delivery, and bear the losses suffered by Party A accordingly.

Sixth Party A

1, Party A shall pay the liquidated damages for overdue payment to Party B according to the ratio of 5/1000 per day.

Seventh force majeure

If either party or Party A fails to perform the contract due to force majeure, it shall promptly notify the other party of the reasons for failure to perform or fail to perform fully, so as to reduce the losses that may be caused to the other party. After obtaining the relevant agency's certificate, it allows permissible delay in performance, partial performance or failure to perform the contract, and may be partially or totally exempt from liability for breach of contract under the circumstances.

Eighth dispute resolution

And the technical units stipulated by the relevant regulations shall conduct quality appraisal, and the two parties shall unconditionally submit to the conclusion of the appraisal.

2, in the execution of this contract dispute, the parties concerned should consult in time to resolve it. If the negotiation fails, either party may bring a lawsuit to the people's court where the contract is signed.

Ninth supervision and management

1, after the conclusion of the contract, the parties concerned need to change the substantive provisions of the contract or make supplementary contracts through consultation. They should first obtain the consent of the government procurement supervision department and send them to the record.

2, both parties should conscientiously cooperate with the relevant supervision and management departments in the supervision and inspection of the performance of the contract, truthfully reflect the situation and provide relevant information; otherwise, the relevant units and the parties concerned will be punished according to the relevant provisions.

Tenth invalid contracts

If both parties fail to declare the contract in violation of the provisions of the government procurement law and relevant laws and regulations, all the liabilities shall be borne by the fault party itself.
