What Should We Pay Attention To Registered Foreign Trade Companies?

          第一條 為促進對外貿易發展，根據《中華人民共和國對外貿易法》（下簡稱《外貿法》）第九條的有關規定，制訂本辦法。

The second foreign trade operators engaged in the import and export of goods or the import and export of technology shall register with the Ministry of Commerce of the People's Republic of China (hereinafter referred to as the Ministry of Commerce) or the institutions entrusted by the Ministry of Commerce. 　

If the foreign trade operator fails to register for registration in accordance with these measures, the customs shall not go through the customs declaration and inspection procedures for import and export.

The third Ministry of commerce is the competent department of the registration and registration of foreign trade operators throughout the country.

Fourth, the registration and registration of foreign trade operators shall be carried out nationally and locally. 　

The local department of foreign trade entrusted by the Ministry of Commerce (hereinafter referred to as the record registration authority) is responsible for the registration procedures for the local foreign trade operators; the entrusted registration authorities may not entrust other institutions to carry on the record and registration.

The registration and registration authority must have the fixed office space necessary for the registration and registration, the full-time personnel who manage, record in, technical support and maintenance, and the conditions connected with the related registration equipment of the Ministry of Commerce's foreign trade operator's registration and registration network (hereinafter referred to as the "registration and registration network").

The Ministry of Commerce may issue a written letter of authorization to the registration and registration authority that meets the above requirements, and issue a record registration seal uniformly produced by the Ministry of Commerce and publish it externally. The registration and registration organ shall go through the registration and registration procedures through the Ministry of Commerce's registration and registration network according to the written letter of entrustment and the registration seal of the Ministry of Commerce. The Ministry of Commerce may reclaim its entrustment for changing circumstances, failing to meet the above conditions, and failing to comply with the provisions of the sixth, seventh provision of these measures for registration and registration.

Fifth procedures for registration and registration of foreign trade operators

Foreign trade operators shall register for registration in the local registration and registration authorities.

The registration procedures for foreign trade operators are as follows:

(1) to receive the registration form for registration of foreign trade operators (hereinafter referred to as "registration form"). Foreign trade operators may pass the website of the Ministry of Commerce. Http://www.mofcom.gov.cn Download or register with the local registration authority.

(two) fill in the registration form. Foreign trade operators should fill out all the information in accordance with the registration form, and ensure that the contents are complete, accurate and authentic. Meanwhile, they carefully read the terms on the back of the registration form and sign and seal them by the legal representatives of enterprises or individual business leaders.

(three) submit the following registration and registration materials to the registration authority: 1, the registration form completed in accordance with the second paragraph of this article; 2, the photocopy of the business license; 3, the photocopy of the organization code certificate; 4, the foreign trade operator as a foreign-funded enterprise, and a copy of the approval certificate of the foreign investment enterprise shall also be submitted; 5, the individual industrial and commercial household (sole proprietor) who has registered the business registration according to law shall submit the property notarization certificate issued by the legal notarial institution; and the foreign (regional) enterprise that handles business registration in accordance with the law shall submit a credit certificate of the capital issued by the legal notary office.

The sixth registration organs shall go through the registration procedures within 5 days from the date of receipt of the above materials submitted by the foreign trade operators, and add the record registration seal to the registration form.

The seventh archival registration organs should record and maintain the registration and registration materials of foreign trade operators in a complete and accurate manner while completing the registration procedures.

The eighth foreign trade operators shall, within 30 days, go through the registration formalities stamped with the registration and registration seals to the local customs, inspection and quarantine, foreign exchange, taxation departments and other related departments for the necessary procedures for carrying out foreign trade business. If the registration is overdue, the registration form will automatically become invalid.

When any registration item changes in the ninth registration form, the foreign trade operator shall, in accordance with the relevant provisions of the fifth and eighth provisions of the present measures, go through the formalities for registration of the registration form within 30 days, and the registration form shall automatically become invalid if the registration procedures are overdue.

After receiving the written materials submitted by the foreign trade operator, the registration and registration authority shall immediately change the formalities.

Tenth foreign trade operators have gone through cancellation procedures or have been revoked their business licenses in the industrial and commercial departments. The registration form is automatically invalid since the date of cancellation or suspension of business licenses.

In accordance with the relevant provisions of the foreign trade law, the Ministry of Commerce decided to prohibit foreign trade operators from engaging in the import and export business of goods or technologies within a period of one year and more than three years. The registration and registration authorities should cancel their registration form. After the expiration of the punishment, foreign trade operators can re register for registration according to these measures.

The eleventh registration authority shall notify the customs, inspection and quarantine, foreign exchange, taxation and other departments in a timely manner after the registration of foreign trade operators is cancelled.

The twelfth foreign trade operators shall not forge, alter, alter, lease, lend, spanfer or sell the registration form.

The thirteenth registration authority shall not collect fees in disguised form when handling registration registration or changing registration.

Fourteenth foreign trade operators who have obtained the qualification for import and export of goods and technologies and have been engaged in import and export business activities within the original approved business scope are no longer required to go through the registration procedures before the implementation of the present measures. Foreign trade operators still need to register in accordance with these measures if they exceed the original quasi business scope to engage in import and export business activities.

The fifteenth way is explained by the Ministry of Commerce. 　

　 The sixteenth measures have been implemented since July 1, 2004. Any provisions inconsistent with the present Measures shall be abolished from the date of promulgation of these measures.
